Tesis ini membahas tentang pemberitahuan lisan dalam pengajuan klaim meninggal dunia sebagai penerapan prinsip utmost good faith dalam asuransi jiwa yang dapat dilihat penerapannya dalam Putusan Pengadilan Negeri Jakarta Selatan Nomor 16/Pdt.G/2016/PN.Jkt.Sel. Permasalahannya adalah: 1) Ketentuan peraturan perundang-undangan perasuransian tentang pemberitahuan lisan terhadap klaim meninggal dunia dalam asuransi jiwa dan 2) Pertimbangan hukum Majelis Hakim dalam Putusan Pengadilan Negeri Jakarta Selatan Nomor 16/Pdt.G/2016/PN.Jkt.Sel sehubungan dengan pemberitahuan lisan dalam pengajuan klaim asuransi jiwa meninggal dunia sebagai penerapan prinsip utmost good faith. Hasil dari penelitian ini adalah: 1) Ketentuan peraturan perundang-undangan perasuransian tentang kewajiban pemberitahuan lisan terhadap klaim meninggal dunia dalam asuransi jiwa belum diatur dalam Undang-Undang Nomor 40 Tahun 2014 dan Peraturan Otoritas Jasa Keuangan Nomor 69/POJK.05/2016 karena hanya memuat ketentuan-ketentuan yang bersifat umum mengenai klaim serta tidak ada ketentuan tentang kewajiban pemberitahuan lisan untuk klaim asuransi jiwa meninggal dunia dan 2) Pertimbangan hukum Majelis Hakim dalam Putusan Pengadilan Negeri Jakarta Selatan Nomor 16/Pdt.G/2016/PN.Jkt.Sel sehubungan dengan pemberitahuan lisan dalam pengajuan klaim asuransi jiwa meninggal dunia sebagai penerapan prinsip utmost good faith adalah tidak sesuai dengan prinsip utmost good faith. Saran dari penelitian ini adalah dimasukkannya materi mengenai hukum asuransi dalam program pelatihan calon hakim dan para hakim.

This thesis discusses verbal notice in filing claim as the application of utmost good faith principle in life insurance which can be seen in its application in the South Jakarta District Court Decision Number 16/Pdt.G/2016/PN.Jkt.Sel. The issues discussed are: 1) Insurance regulations regarding verbal notice of death claims in life insurance and 2) The legal considerations of the Judges in the South Jakarta District Court Decision Number 16/Pdt.G/2016/PN.Jkt.Sel in connection with the verbal notice in filing death claim as the application of the utmost good faith principle in life insurance. The theories used are the theory of legal certainty and the theory of utmost good faith principle. The results of this study are: 1) The insurance legislation regarding the obligation to notify death claims in life insurance have not been regulated in Law Number 40 of 2014 and POJK Number 69/POJK.05/2016 because it only contains provisions that are general about claims and there are no provisions regarding the obligation of verbal notice for death insurance claims and 2) Legal considerations of Judges in the South Jakarta District Court Decision Number 16/Pdt.G/2016/PN.Jkt.Sel in connection with the verbal notice in filing death claim as the application of the utmost good faith principle is not in accordance with the principle of utmost good faith. Suggestions from this research are to put material about insurance law in prospective judges and judges training program.
