Perubahan iklim dapat memberikan dampak negatif terhadap penikmatan dari hak asasi manusia (HAM), salah satu hak yang dianggap paling signifikan terancam adalah hak untuk hidup. Hak untuk hidup merupakan non-derogable rights yang tidak dapat dikurangi pemenuhannya dalam keadaan apapun. Salah satu akibat dari perubahan iklim dapat dilihat melalui fenomena terpaksanya perpindahan manusia terhadap mereka yang disebut sebagai Environmentally-Displaced Persons (EDPs). Terlepas dari urgensi permasalahan ini, belum terdapat instrument hukum internasional yang dapat melindungi mereka. Namun, Human Rights Committee (HRC) memberikan peluang perlindungan terhadap para EDPs akibat perubahan iklim untuk tidak dikembalikan ke negara asalnya. HRC menyatakan bahwa perubahan iklim merupakan salah satu ancaman yang paling mendesak dan serius serta dapat menghadapkan individu terhadap pelanggaran atas hak untuk hidup. Hal ini maka dapat memunculkan kewajiban bagi Negara untuk tidak mengembalikan mereka ke negara asal atau non-refoulement obligations. Walaupun demikian, terdapat komponen-komponen yang harus dipenuhi oleh EDPs akibat perubahan iklim untuk mendapatkan perlindungan tersebut, termasuk risiko yang ia hadapi haruslah nyata dan tidak dapat diperbaiki, serta bersifat pribadi. Climate change can have a negative impact on the enjoyment of human rights, one of the rights that is considered to be the most significantly threatened is the right to life. The right to life is a non-derogable right which cannot be reduced under any circumstances. One of the consequences of climate change can be seen through the phenomenon of forced displacement of people against them which is called Environmentally-Displaced Persons (EDPs). Despite the urgency of this problem, there is no international legal instrument that can protect them. However, the Human Rights Committee (HRC) provides an opportunity to protect EDPs due to climate change from being returned to their countries of origin. The HRC states that climate change is one of the most urgent and serious threats and can expose individuals to violations of the right to life. This can then give rise to an obligation for the State not to return them to the country of origin or non-refoulement obligations. However, there are components that must be met by EDPs due to climate change in order to obtain such protection, including the risks that they face must be real and irreversible, as well as personal. The fulfillment of the right to life component in this environmental context can be seen in the case of Ioane Teitiota v. New Zealand that is considered as a landmark decision in protecting EDPs due to climate change.
