Pembangunan Ibu Kota Negara Nusantara merupakan salah satu wacana yang diumumkan pada tanggal 26 Agustus 2019, yang akan dipindah dari DKI Jakarta ke Penajam Paser Utara, Kalimantan Timur dengan nama Nusantara yang merupakan salah satu dari Program Strategis Nasional. Permasalahan yang akan timbul ialah hilangnya 40% (empat puluh persen) luas hutan produksi yang akan mengakibtakan ikut hilangnya hutan bagi ekosistem para satwa- satwa liar khususnya dilindungi yang berada di Kabupaten Penajam Paser Utara. Atas hal tersebut penelitian ini berbentuk Yuridis Normatif yang bersifat Deskriptif, didapatkan melalui Data Sekunder yang diperoleh melalui Studi Kepustakaan. Data Sekunder antara lain menggunakan Bahan Hukum Primer, Bahan Hukum Sekunder, dan Bahan Hukum Terseir dengan alat pengumpukan data berupa Studi Dokumen. Dimana Metode Analisis yang digunakan adalah Analisis Kualitatif dengan Bentuk Hasil Penelitian Deskriptif. Sehingga simpulan yang didapat dari penulisan ini ialah; pembentukan kebijakan yang dimuat dalam Hukum Positif yang mengatur tentang pembangunan Ibu Kota Negara Nusantara hanya menjadikan ketentuan mengenai Perlindungan dan Pengelolaan Lingkungan Hidup sebagai formalitas saja. Maka utamanya adalah untuk tidak melupakan keberadaan atas flora dan fauna yang merupakan salah satu rantai kehidupan yang berperan sangat penting demi kehidupan masyarakat dan umat.

The construction of the National Capital City of the Nusantara is one of the discourses announced on August 26, 2019, which will be moved from DKI Jakarta to Penajam Paser Utara, East Kalimantan under the name Nusantara which is one of the National Strategic Programs. The problem that will arise is the loss of 40% (forty percent) of the production forest area which will result in the loss of forest for the ecosystem of wild animals, especially protected ones in Penajam Paser Utara. For this reason, this research is in the form of normative juridical which is descriptive, obtained through secondary data obtained through library research. Secondary data, among others, uses Primary Legal Materials, Secondary Legal Materials, and Secondary Legal Materials with data collection tools in the form of Document Studies. Where the method of analysis used is qualitative analysis with the form of descriptive research results. So, the conclusions obtained from this writing are the formation of policies contained in the Positive Law which regulates the development of the National Capital City of the Nusantara only makes provisions regarding Environmental Protection and Management as a formality. The main thing is not to forget the existence of flora and fauna which are one of the chains of life that play a very important role for the life of society and the people.
