Skripsi ini mengkaji mengenai aturan-aturan hukum yang melandasi tata cara penyusunan informed consent di Indonesia, implikasi penggunaan klausul baku informed consent dalam transaksi terapeutik untuk memenuhi prinsip perlindungan hukum dan konstruksi hukum informed consent agar memiliki kekuatan hukum sebagai alat bukti yang sah dan kuat dalam persidangan. Penulisan skripsi ini menggunakan metode yuridis-normatif dengan tipe penelitian deskriptif-preskriptif, data penelitian dikumpulkan melalui data sekunder yang terdiri dari bahan hukum, dan data primer melalui wawancara mendalam dengan narasumber. Adapun simpulan dari penelitian ini adalah: pengaturan penyusunan informed consent diatur dalam Undang-Undang Nomor 29 Tahun 2004 tentang Praktik Kedokteran, Peraturan Menteri Kesehatan Republik Indonesia Nomor 290/MENKES/PER/III/2008 tentang Persetujuan Tindakan Kedokteran, dan Manual Persetujuan Tindakan Kedokteran Tahun 2006. Implikasi klausul baku dalam penyusunan informed consent telah meningkatkan pemenuhan prinsip perlindungan hukum karena dapat memastikan bahwa adanya hubungan dokter dan pasien dimana dokter telah memberikan informasi perihal tindakan medis dan pasien telah memberikan persetujuan secara sukarela setelah mendapatkan informasi medis dari dokter. Adapun konstruksi informed consent agar dapat memenuhi prisnsip perlindungan hukum setidak-tidaknya memuat 3 (tiga) klausul baku informed consent yaitu identitas pasien dan dokter, informasi medis berdasarkan Pasal 45 UU Praktik Kedokteran, dan tanda tangan pasien dan dokter.

This thesis examines the legal rules that underline the procedures for preparing informed consent in Indonesia, the implications of using standard clauses of informed consent in therapeutic transactions to fulfill the principle of legal protection and the legal construction of informed consent so that it has legal force as valid and strong evidence in court. This thesis is using juridical-normative methods, with descriptive-prescriptive research type, research data was collected through secondary data consisting of legal material, and primary data through in-depth interviews with source. The conclusions of this study are: arrangements for the preparation of informed consent are regulated in Law Number 29 of 2004 concerning Medical Practices, Regulation of the Minister of Health Republic of Indonesia Number 290/MENKES/PER/III/2008 concerning Approval of Medical Actions and Manual of Approval of Medical Actions 2006. The implication of standard clauses in informed consent has increased the fulfillment of the principle of legal protection because it can ensure that there is a doctor-patient relationship whereas the doctor has provided information about medical actions and the patient has given voluntary consent after receiving medical information from the doctor. The construction of informed consent in order to fulfill the principles of legal protection contains at least 3 (three) standard clauses of informed consent which is the identity of the patient and doctor, medical information based in Article 45 of the Medical Practice Law, dan the patient and doctor signatures.
