Notaris dalam kewenangannya untuk membuat suatu akta pernyataan keputusan rapat, wajib secara saksama meneliti kesesuaian baik keterangan maupun dokumen-dokumen yang digunakan sebagai dasar pembuatan akta dengan ketentuan perundang-undangan, agar akta tersebut tidak menimbulkan kerugian bagi para pihak, notaris maupun pihak ketiga. Seperti dalam kasus yang diteliti pada tesis ini, di mana akta pernyataan keputusan rapat pembina yayasan yang dibuat notaris dinyatakan tidak sah dan tidak berkekuatan hukum oleh putusan pengadilan, karena undangan rapat pembina tersebut dinyatakan tidak sesuai dengan mata acara yang dibahas, dan tidak berwenangnya rapat pembina tersebut untuk memberhentikan ketua pembina dari jabatannya. Permasalahan yang diangkat dalam tesis ini meliputi keabsahan pelaksanaan rapat pembina yayasan yang undangannya tidak sesuai dengan mata acara rapat, dan akibat hukum terhadap akta pernyataan keputusan rapat yang dibuat berdasarkan rapat pembina tersebut. Metode penelitian yang dipergunakan adalah yuridis normatif dengan tipe eksplanatoris. Hasil penelitian tesis ini menyimpulkan bahwa undangan rapat telah sesuai dengan mata acara rapat dan pelaksanaan rapat pembina yayasan dilaksanakan sesuai dengan ketentuan perundang-undangan, maka hasil keputusan rapat tersebut adalah sah, sehingga seharusnya tidak menimbulkan akibat hukum yaitu batal demi hukum terhadap akta notaris yang dibuat berdasarkan rapat tersebut. Saran dalam tesis ini yaitu notaris sebelum membuatkan akta pernyataan keputusan rapat, seharusnya dapat memberikan penyuluhan hukum dan secara saksama memastikan dengan para pihak terkait isi keputusan agar tidak terjadi perbedaan kehendak yang dapat berujung pada masalah hukum yang dapat terjadi dikemudian hari yang akan berdampak pada para pihak maupun nama baik notaris itu sendiri.

A notary under the authority to make a deed of meeting decision, is obliged to examine whether the information and documents used as the basis for making the deed is already in accordance with the provisions of the law, so that the deed will not cause issues to the parties, the notary itself as well as the third parties. As in the case studied in this thesis, the deed of the decision of foundation trustees meeting made by the notary is declared invalid and has no legal force by a court decision, because the invitation to the meeting of trustees is declared not in accordance with the discussed agenda, and the meeting of trustees has no authority to dismiss the chairman of the trustees from the position. The issues discussed in this thesis are regarding the validity of the foundation trustees meeting which the invitation is not in accordance with the agenda of the meeting, and the legal consequences of the deed of meeting decisions made based on the trustees meeting. The research method used in this thesis is normative juridical with explanatory research type. The result of this research concludes that the meeting invitation is in accordance with the meeting agenda and the foundation trustees meeting held were in accordance with the statutory provisions, which leading to a result of the meeting's decision is valid, so it should not cause legal consequences against the notary deed made based on the meeting. The suggestion in this thesis is that a Notary should be able to provide legal counselling and carefully ensure with the parties related to the content of the decision, before making a deed of meeting decision, so that there are no differences of will that can lead to legal problems that can occur in the future which will have an impact on the parties and the reputation of the Notary itself.
