 Abstract

Penelitian ini dilakukan untuk menjelaskan tanggung jawab hukum dokter terkait pelaksanaan perintah jangan lakukan resusitasi dengan melakukan studi perbandingan tiga negara, yaitu Indonesia, Belanda dan Uni Emirat Arab. Hal-hal yang dibahas dalam skripsi ini terdiri dari: (1) perbandingan regulasi perintah jangan lakukan resusitasi di Indonesia, Belanda, dan Uni Emirat Arab, (2) perbandingan regulasi tanggung jawab dokter yang melaksanakan penolakan tindakan medis di Indonesia, Belanda, dan Uni Emirat Arab, (3) perbandingan regulasi tanggung jawab dokter yang melaksanakan perintah jangan lakukan resusitasi di Indonesia, Belanda, dan Uni Emirat Arab. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis normatif dengan sumber data yang diperoleh dari studi kepustakaan dan wawancara. Dari hasil penelitian ditemukan bahwa perintah jangan lakukan resusitasi diakui di Indonesia, Belanda, maupun Uni Emirat Arab. Dokter tidak bertanggung jawab atas akibat atau efek samping yang ditimbulkan dari pelaksanaan penolakan tindakan medis dan perintah jangan lakukan resusitasi baik di Indonesia, Belanda, maupun Uni Emirat Arab. Penulis berpendapat perlu adanya pengaturan yang lebih komprehensif mengenai batas usia kompeten pasien yang dapat mengajukan penolakan tindakan medis, praktik jangan lakukan resusitasi, dan dokter penilai. Selain itu, Indonesia dapat mencontoh praktik jangan lakukan resusitasi di Belanda yang lebih efisien.

This study aims to explain the physicians' liability regarding the implementation of the do not resuscitate order by conducting a comparative study of three countries, which include Indonesia, the Netherlands, and the United Arab Emirates. The subjects discussed in this thesis consist of: (1) comparison of regulations on the do not resuscitate order in Indonesia, the Netherlands, and the United Arab Emirates, (2) comparison of the regulations on physicians' liability who carry out informed refusal in Indonesia, the Netherlands, and the United Arab Emirates, (3) comparison of the regulations on the physicians’ liability who carry out the do not resuscitate order in Indonesia, the Netherlands, and the United Arab Emirates. The research method used in this study is normative juridical with data sources obtained from literature study and interview. The results of the study show that the do not resuscitate order is recognized in Indonesia, the Netherlands, and the United Arab Emirates. The physician is not liable for the consequences or side effects arising from the implementation of the informed refusal and the order do not resuscitate order either in Indonesia, the Netherlands, or the United Arab Emirates. In the author's opinion, more comprehensive regulation is needed regarding the age limit for patients who can submit informed refusals, the practice of do not resuscitate, and the assessing physician. Furthermore, Indonesia can follow the more efficient do not resuscitate practice in the Netherlands.
