Penelitian ini membahas mengenai jabatan seorang Notaris dapat berakhir karena telah berusia 65 tahun sehingga ia harus pensiun atau dapat pula berakhir karena Notaris meninggal dunia. Apabila Notaris pensiun ataupun meninggal dunia maka harus ada Notaris lain yang akan menggantikannya sebagai pemegang dari protokol-protokol Notaris yang ia miliki semasa jabatannya sebagai Notaris. Adapun hal itu bertujuan agar Protokol Notaris yang ditinggalkan tetap terjaga dan terpelihara dengan baik. Penelitian ini mengangkat permasalahan mengenai, proses penyerahan Protokol Notaris yang telah meninggal dunia oleh ahli warisnya; dan, konsekuensi dan status terhadap Protokol Notaris dalam hal Notaris yang meninggal dunia.  Untuk menjawab permasalahan tersebut, penelitian ini menggunakan pendekatan yuridis empiris. Penelitian ini menggunakan data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier, pernelitian ini menggunakan metode analisis data secara deskriptif analisis dengan pendekatan kualitatis. Hasil dari penelitian ini adalah proses penyerahan protokol Notaris yang meninggal dunia dilakukan oleh ahli waris dari Notaris dengan melakukan pelaporkan atas meninggalnya Notaris kepada Majelis Pengawas Daerah dan setelah itu ditunjuklah Notaris pemegang protokol oleh Majelis Pengawas Daerah serta konsekuensi dan status terhadap Protokol Notaris yang ditinggalkan Notaris yang meninggal dunia adalah hilangnya orang yang bertanggungjawab untuk menjaga dan memelihara Protokol Notaris. Protokol Notaris wajib diserahkan kepada Notaris Penerima Protokol agar tetap dapat terjaga dan terpelihara sehingga adanya kejelasan dan kepastian hukum siapa yang berwenang dan berhak atas Protokol Notaris tersebut.

This study discusses the position of a Notary that can end because they are 65 years old, so they must retire, or it can also end because the Notary passes away. If the Notary retires or passes away, there must be another Notary who will replace them as the holder of the Notary protocols they had during their tenure as a Notary. This aims to ensure that the Notary Protocol left behind is preserved and well-maintained. This study raises the questions, "How is the process of submitting a Notary Protocol who has passed away by their heirs?" and "What are the consequences and status of the Notary Protocol in the case of a Notary who passes away?" This study used an empirical juridical approach to answer these questions. This study used secondary data consisting of primary legal materials, secondary legal materials, and tertiary legal materials, and this research used descriptive data analysis methods with a qualitative approach. The results of this study are that the process of submitting the protocol of a Notary who has passed away is carried out by the heirs of a Notary by reporting the death of a Notary to the MPD. After that, MPD will appoint a Notary who will hold the protocol, and the consequences that arise on the Notary Protocol left behind is the loss of the person responsible for preserving and maintaining the Notary Protocol. The Notary Protocol must be submitted to the Notary Recipient of the Protocol so that it can be maintained and maintained so that there is clarity and legal certainty as to who is authorized and entitled to the Notary Protocol.
