Seiring dengan pesatnya kemajuan teknologi, pertumbuhan pinjaman online berbasis peer-to-peer (P2P) lending di tanah air mengalami kemajuan pesat. Sayangnya, hal ini memunculkan ancaman teror dengan kekerasan, penghinaan, pencemaran nama baik dari perusahaan P2P lending, seperti yang dilakukan oleh Koperasi Simpan Pinjam (KSP) Inovasi Milik Bersama. Penelitian ini bertujuan untuk menganalisis proses penyidikan yang dilakukan oleh Ditipideksus Bareskrim Polri dan alasan para tersangka dalam kasus pinjaman online ilegal KSP Inovasi Milik Bersama tidak dijerat hukum tindak pidana korporasi. Penelitian ini menggunakan metode kualitatif melalui studi kasus terhadap kasus KSP Inovasi Milik Bersama. Pengumpulan data dilakukan dengan cara wawancara kepada personel Dittipideksus Bareskrim Polri dan OJK dan studi dokumentasi terhadap peraturan perundang-undangan serta berita acara hasil penyidikan kasus tersebut. Hasil penelitian ini menunjukkan bahwa proses penyidikan yang dilakukan sudah sesuai dengan prosedur yang berlaku dalam Kapolri Nomor 6 Tahun 2019 tentang Penyidikan Tindak Pidana dimana saat ini proses penyidikan sudah sampai penyerahan tersangka dan barang bukti ke pengadilan. Berdasarkan hasil penyidikan tersebut, korporasi ini diidentifikasi sebagai crime corporation atau perusahaan yang secara sengaja didirikan untuk tujuan kejahatan. Kasus KSP Inovasi Milik Bersama tidak dikenakan pertanggungjawaban korporasi karena di dalam KUHP belum menganggap korporasi sebagai subjek hukum serta belum tercapainya kesepahaman antara penegak hukum terkait hal tersebut.

Along with the rapid advances in technology, the growth of online lending based on peer-to-peer (P2P) lending in the country is progressing rapidly. Unfortunately, this raises the threat of terror with violence, humiliation, and defamation from P2P lending companies, such as KSP Inovasi Milik Bersama. This study aims to analyze the investigation process carried out by the Ditipideksus Bareskrim Polri and the reasons the suspects in the case of the illegal online loan of KSP Inovasi Milik Bersama were not charged with corporate criminal law. This study uses a qualitative method through a case study of the case of the KSP Inovasi Milik Bersama. Data was collected by interviewing the personnel of the Dittipideksus Bareskrim Polri and OJK and studying documentation of the laws and regulations as well as the minutes of the results of the investigation of the case. The results of this study indicate that the investigation process carried out is in accordance with the procedures in force in the National Police Chief Number 6 of 2019 concerning Criminal Investigations where currently the investigation process has reached the submission of suspects and evidence to court. Based on the results of the investigation, this corporation is identified as a crime corporation or a company that is intentionally established for criminal purposes. The case of the KSP Inovasi Milik Bersama is not subject to corporate responsibility because the Criminal Code does not yet consider corporations as legal subjects and an understanding has not been reached between law enforcement regarding this matter.
