Tulisan ini membahas tentang penerapan prinsip fair trial terhadap kasus terpidana hukuman mati kejahatan narkotika. Studi ini melakukan analisis data sekunder dari 10 kasus terpidana hukuman mati narkotika. Analisis dilakukan dengan sistem coding yang memperlihatkan variabel demografi pelaku dan penerapan prinsip fair trial dalam setiap kasus. Hasil penelitian ini menemukan bahwa prinsip fair trial yang dilanggar pada kasus terpidana hukuman mati narkotika, diantaranya: (1) hak atas kedudukan yang sama di hadapan hukum; (2) hak atas waktu dan fasilitas memadai untuk mempersiapkan pembelaan; (3) hak untuk dianggap tidak bersalah sebelum dibuktikan oleh hukum; (4) hak untuk membela diri secara langsung atau melalui pembela yang dipilih sendiri; (5) hak untuk tidak dipaksa memberikan kesaksian yang memberatkan atau dipaksa mengaku bersalah; (6) hak untuk memeriksa saksi-saksi yang memberatkan ataupun meringankan; (7) hak untuk diberitahukan secepatnya dan secara rinci tentang sifat dan alasan tuduhan; (8) hak atas bantuan secara cuma-cuma dari penerjemah; dan (9) hak untuk diadili tanpa penundaan. Temuan ini mencerminkan bahwa sistem peradilan pidana bukan hanya tidak berkeadilan, akan tetapi melakukan bentuk pembiaran terhadap praktik pelanggaran hak asasi manusia secara berulang yang merupakan state crime.

This paper discusses the implementation of the fair trial principle in the case of people that faced the death penalty for drugs crimes. This study analyzes 10 cases of people who are sentenced to be executed for drugs crimes. The analysis is made with coding system that shows the demographic variables of the convicted person and the implementation of the fair trial principles in each case. The results of this study found that the fair trial principles were violated in the case of people who faced the death penalty for drugs crimes, including: (1) equality before the law; (2) the right to have reasonable time and facilities to prepare a proper defense; (3) the right to be presumed innocent until proven guilty by law; (4) the right to defend themselves directly or through a chosen defense counsel; (5) the right not to be forced to give incriminating testimony or to plead guilty; (6) the right to examine both incriminating and mitigating witnesses; (7) the right to be informed promptly and in detail of the charges; (8) the right to the free assistance of an interpreter; and (9) the right to receive adequate trial without delays. This findings reflects that the criminal justice system is not only unfair, but has also neglected the practice of repetitive human rights violations that are referred as state crimes.
