Koperasi merupakan badan hukum yang berorientasi pada kesejahteraan anggota pada khususnya dan kemakmuran rakyat pada umumnya. Namun, masih terdapat kasus dimana anggota memohonkan pailit Koperasinya sendiri dan juga anggota yang tidak setuju atas kepailitan tersebut. Skripsi ini membahas mengenai 2 (dua) hal yaitu mengenai perlindungan terhadap anggota koperasi yang telah dinyatakan pailit dan mengenai peran Kementerian Koperasi dan Usaha Kecil dan Menengah (“Kemenkop UKM”) dalam memberikan perlindungan terhadap anggota Koperasi dalam perkara kepailitan Koperasi. Metode Penelitian yang digunakan dalam skripsi ini adalah secara kualitatif dengan bentuk penelitian yuridis-normatif yaitu pengkajian melalui hukum positif yang berlaku. Adapun hasil penelitian yang telah dilakukan penulis menunjukkan bahwa belum terdapat aturan yang dapat mengakomodasi kepentingan anggota dalam hal kepailitan Koperasi dan masih terdapat kurangnya kesadaran hukum anggota akan kedudukannya dalam koperasi. Di sisi lain, peran Kemenkop UKM dalam upaya perlindungan anggota Koperasi dalam kepailitan adalah dengan membentuk Satuan Tugas Penanganan Koperasi Bermasalah dan melakukan sinkronisasi dengan pihak eksternal. Namun, sebagai upaya preventif, Kemenkop UKM belum membuat kebijakan kepailitan Koperasi secara terkhusus sehingga masih terdapat Koperasi yang bertindak sewenang-wenang dalam menjalankan usahanya.

Cooperatives are legal entities that are oriented towards the welfare of members in particular and the prosperity of the people in general. However, there are still cases where members apply for bankruptcy of their own Cooperative and also members who disagree with the insolvency. This thesis discusses 2 (two) things, namely regarding the protection of cooperative members who have been declared bankrupt and regarding the role of the Ministry of Cooperatives and Small and Medium Enterprises ("Ministry of Cooperatives and SMEs") in providing protection for cooperative members in cooperative bankruptcy cases. The research method used in this thesis is qualitatively with a juridical-normative form of research, namely assessment through applicable positive law. The results of research that has been carried out by the author show that there are no rules that can accommodate the interests of members in terms of cooperative insolvency and there is still a lack of legal awareness of members about their position in the cooperative. On the other hand, the role of the Ministry of Cooperatives and SMEs in efforts to protect cooperative members in bankruptcy is to form a Task Force for Handling Problematic Cooperatives and synchronize with external parties. However, as a preventive measure, the Ministry of Cooperatives and SMEs has not made a cooperative insolvency policy specifically so that there are still cooperatives that act arbitrarily in carrying out their business.
