Apotek merupakan sarana pelayanan kefarmasian tempat dilakukan pekerjaan kefarmasian oleh apoteker. Dalam memberikan pelayanan kefarmasian di Apotek, dapat dilakukan oleh apoteker, tenaga ahli kefarmasian dan asisten tenaga kefarmasian. Seorang pasien dapat menebus resep obat yang diberikan oleh dokter ke apotek. Namun, terdapat permasalahan apabila yang memberikan pelayanan kefarmasian tersebut bukanlah tenaga kefarmasian. Terlebih lagi, apabila obat yang diberikan tersebut menyebabkan pasien menjadi tidak sadarkan diri akibat ketidaksesuaian obat yang diberikan oleh pihak apotek dengan obat yang tertulis di dalam resep dokter. Kasus serupa telah terjadi di salah satu apotek di Medan dimana pasien mengalami penurunan kesadaran, hipoglicemia, stroke, serta adanya suspek. Oleh karena itu, penulis ingin membahas dan meneliti bagaimana perlindungan hukum bagi pasien terhadap pengolahan obat berdasarkan resep dokter oleh apotek dengan menganalisis Putusan Pengadilan Negeri Medan Nomor 2258/Pid.Sus/2020/Pn Mdn. Telah terjadi kesalahan serta kelalaian dalam kasus tersebut, antara lain mengenai tanggung jawab apoteker, pelayanan resep, serta kesalahan pemberian sediaan farmasi atau obat oleh tenaga non kefarmasian yang menyebabkan korban tidak sadarkan diri. Penulis menyarankan bagi Dinas Kesehatan untuk meningkatkan pengawasan serta apotek untuk memiliki standar operasional prosedur yang komprehensif.

Pharmacy is a pharmaceutical service facility where pharmacists practice pharmacy. In providing pharmaceutical services, it can be done by pharmacists, pharmaceutical experts and assistant pharmacy staff. A patient can redeem their drug prescription given by a doctor to a pharmacy. However, this could cause a problem if the one who gives the drug is not a pharmacist nor pharmacist assistant nor assistant pharmacy staff. Moreover, if the drug given causes the patient to become unconscious due to the incompatibility of the drug given by the pharmacy with the drug written in the doctor's prescription. A similar case had occurred in a pharmacy in Medan where the patient had hypoglycemia, stroke, suspected hypertensive heart disease and lost consciousness. Therefore, author wants to analyze and examine the legal protection for patient in drug processing based on doctor's prescriptions by pharmacies by analyzing the Medan District Court Decision Number 2258/Pid.Sus/2020/Pn Mdn. There have been fallacies and omissions in cases involving the pharmacist's responsibility, prescription services, and errors in drug processing by non-pharmaceutical staff which caused the victim to become unconscious. The author suggests for the Health Agency to improve their supervision and for pharmacies to have more comprehensive standard operating procedures.
