Dewasa ini, sering dijumpai permasalahan pendaftaran merek. Salah satunya terkait ketidaksesuaian penerimaan merek yang bertentangan dengan Pasal 20 Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis. Terutama pada Pasal 20 huruf (b) dan (f) dimana dalam penjelasan undang-undang tersebut juga tidak dijelaskan secara spesifik terkait kriteria merek yang “sama dengan, berkaitan dengan, atau hanya menyebut barang jasa yang dimohonkan pendaftaran” dengan merek yang “merupakan nama umum dan/atau lambang umum”. Sebagai contoh akibat ketidakjelasan pasal tersebut yakni pada kasus merek “Open Mic Indonesia”. Dalam penulisan hukum ini penulis melakukan penelitian menggunakan metode yuridis normatif yang didukung dengan wawancara narasumber. Berdasarkan penelitian yang dilakukan penulis menyimpulkan bahwa Pasal 20 huruf (b) penggunaan kata yang digunakan pada merek memiliki hubungan langsung terhadap produk sebagai deskripsi, sedangkan Pasal 20 huruf (f) penggunaan kata yang terlah digunakan sebagai bahasa sehari-hari atau dimiliki umum. Merek “Open Mic Indonesia” berdasarkan doktrin spectrum of distinctiveness memiliki kekuatan pembeda yang rendah karena frasa “open mic” merupakan generic term. Dimana hakim pada putusan No:85/Pdt.Sus-HKI/Merek/2022/PN.Niaga.Jkt.Pus berpendapat bahwa “open mic” merupakan istilah umum dan hakim memutus untuk membatalkan merek tersebut karena dinilai bertentangan dengan kepentingan umum dan adanya iktikad buruk.

Trademark "Open Mic Indonesia" based on the doctrine of spectrum of distinctiveness has a low distinguishing power because the phrase "open mic" is a generic term. Where the judge in Decision No: 85/Pdt.Sus-HKI/Merek/2022/PN.Niaga.Jkt.Pus argued that "open mic" is a generic term and the judge decided to cancel the trademark because it was considered contrary to the public interest and bad faith.
