Penelitian ini membahas mengenai perlindungan hukum terhadap hak pembeli yang melakukan jual beli tanah warisan dengan salah satu ahli waris tanpa adanya persetujuan dan sepengetahuan ahli waris lainnya. Hak pembeli sebagai pembeli beritikad baik yang harus mendapatkan perlindungan hukum seringkali tidak dapat dipertahankan oleh hakim, sehingga perlu diteliti mengenai bagaimana kriteria pembeli beritikad baik yang diakui oleh hukum dan bagaimana bentuk perlindungan terhadap pembeli beritikad baik terhadap sengketa tanah. Metode penelitian yang digunakan adalah secara yuridis normatif. Fokus penelitian ini adalah mengetahui apakah Tergugat I yang merupakan pembeli tanah warisan tersebut termasuk ke dalam kriteria pembeli beritikad baik dan dapat diberikan perlindungan hukum atau tidak dengan didasari dari teori-teori peraturan perundang-undangan mengenai itikad baik, serta apa saja bentuk perlindungan hukum yang dapat diberikan kepada Tergugat I sebagai pembeli jika termasuk ke dalam kriteria beritikad baik, dan terakhir penelitian ini akan mengelaborasi mengenai pertimbangan hakim dalam putusan, apakah sudah tepat atau tidak. Hasil akhir dari penelitian ini menunjukkan bahwa putusan hakim kurang tepat dilihat dari teori-teori hukum yang berkembang dan peraturan perundang-undangan yang berlaku. Walaupun putusan hakim lebih mengedepankan keadilan dibandingkan kepastian hukum itu sendiri, namun seharusnya dalam memberikan putusan hakim dapat mencerminkan putusan yang adil dan sesuai dengan norma hukum secara seimbang.

This thesis discusses about legal protection of buyer’s rights who buy inherited land with one of the heirs without the consent and knowledge of the other heirs. The rights of a well-intentioned buyer, who should receive legal protection, are often challenging for judges to uphold. Hence, it is necessary to examine the criteria for a bona fide buyer recognized by the law and the forms of protection available to bona fide buyers in land disputes. This thesis using normative juridical method. The focus of this thesis is to find out whether first Defendant, who is the buyer of the inherited land is included in the criteria for a good faith buyer and can be given legal protection or not by supporting the theories of laws and regulations regarding good faith, as well as what forms of legal protection can be given to first Defendant as a buyer if it is included in the criteria of good faith, and finally this research will elaborate on the judge's considerations in the decision, whether it is appropriate or not. The final results of this study indicate that the judge's decision is not quite right according to the developing legal theories and applicable laws and regulations. Even though the judge's decision prioritizes justice rather than legal certainty itself, however in giving decisions, judge's should be able to reflect a fair decision and in accordance with legal norms in a balanced manner way.
