 Abstract

Skripsi ini mengeksplorasi perbandingan antara pengaturan harga Bahan Bakar Minyak (BBM) di Indonesia dan Belanda, dengan mempertimbangkan hukum persaingan usaha. Penelitian ini menggunakan metode penelitian yuridis normatif untuk mengkaji dan membandingkan peraturan dan kebijakan harga BBM di kedua negara tersebut. Metode ini melibatkan studi pustaka melalui pengumpulan data sekunder dari berbagai sumber, termasuk peraturan perundang-undangan, putusan pengadilan dan KPPU, laporan dari badan seperti OPEC, dan literatur akademis. Kajian tersebut mengungkapkan bahwa pengaturan harga BBM oleh pemerintah seringkali berdampak pada minimnya persaingan, walaupun membawa stabilitas harga jangka pendek untuk konsumen. Sebaliknya, Belanda menerapkan model pasar bebas, dimana harga BBM ditentukan oleh penawaran dan permintaan di pasar. Hasil penelitian menunjukkan bahwa model ini mendorong persaingan yang lebih kuat di antara perusahaan BBM, tetapi dapat menimbulkan fluktuasi harga yang signifikan bagi konsumen. Penelitian ini juga mencoba memberikan rekomendasi kepada pemerintah Indonesia dalam pengaturan harga BBM untuk meningkatkan persaingan usaha dan kestabilan ekonomi jangka panjang. Penelitian ini penting untuk memahami bagaimana pengaturan harga BBM dan hukum persaingan usaha berinteraksi dan mempengaruhi ekonomi suatu negara.

This thesis explores the comparison between the regulation of fuel prices in Indonesia and the Netherlands, considering the competition law. This research uses a normative juridical research method to review and compare the regulations and policies of fuel prices in both countries. This method involves literature studies through the collection of secondary data from various sources, including legislative regulations, court and KPPU decisions, reports from bodies like OPEC, and academic literature. The study reveals that government regulation of fuel prices often leads to minimal competition, even though it brings short-term price stability for consumers. In contrast, the Netherlands applies a free-market model, where fuel prices are determined by supply and demand in the market. The research results show that this model encourages stronger competition among fuel companies, but it can cause significant price fluctuations for consumers. This research also tries to provide recommendations to the Indonesian government in fuel price regulation to improve business competition and long-term economic stability. This research is important to understand how the regulation of fuel prices and competition law interact and influence a country's economy.
