Tesis ini membahas Putusan Pengadilan Tata Usaha Negara dengan Nomor: 11/G/2018/PTUN/PDG mengenai keabsahan penerbitan suatu Sertipikat hak milik atas tanah berupa tanah fasilitas umum yang dimana sejak tahun 1953 tanah tersebut telah diserahkan guna kepentingan pembangunan Kabupaten Pasaman Barat. Permasalahan dari penelitian ini adalah bagaimana keabsahan dari penerbitan Sertipikat tanah yang objeknya berupa tanah fasilitas umum serta bagaimana keabsahan dari penerbitan Sertipikat hak milik atas tanah berupa tanah fasum dengan Nomor 9409/Nagari Lingkuang Aua. Untuk menjawab pemasalahan tersebut digunakan metode yuridis normatif dengan tipologi penelitian deskriptif analitis. Adapun analisa data dilakukan dengan pendekatan undang-undang (statute apprach) dan pendekatan kasus (case approach). Hasil penelitian ini adalah tidak sahnya suatu sertipikat yang dikeluarkan oleh BPN terhadap tanah Fasilitas Umum terutama tanah Fasilitas Umum yang berada di suatu perumahan karena bertentangan dengan Undang-Undang No.1 Tahun 2011 tentang Perumahan dan Kawasan Permukiman. Dan juga perihal tidak sahnya suatu Sertipikat tanah yang digunakan sebagai Fasilitas Umum, sebagaimana dengan putusan Hakim dalam kasus ini adalah tidak sah, sehingga dibatalkanya Sertipikat hak milik dengan nomor: 9409/Nagari Lingkuang Aua, dalam hal ini pegawai BPN wajib melaksanakan tugasnya sesuai peraturan yang ada dan juga sebaiknya suatu tanah Fasilitas Umum dilakukan pencatatan dalam buku tanah, dilindungi baik secara fisik dengan dibangun fasilitas umum, dipagar, ataupun diberi tanda dan juga dilindungi secara hukum dengan mensertifikatkan tanah Fasilitas Umum tersebut.

This thesis discusses the Decision of the State Administrative Court Number: 11 / G / 2018 / PTUN / PDG regarding the validity of the issuance of a certificate of ownership rights over land in the form of public facilities, which since 1953 the land has been handed over for the benefit of the development of Pasaman Barat Regency. The problem of this research is how is the validity of the issuance of land certificate whose object is in the form of public facilities and how is the validity of the issuance of certificate of ownership rights to land in the form of public land with Number 9409 / Nagari Lingkuang Aua. To answer these problems, a normative juridical method with a descriptive analytical research typology was used. The data analysis was carried out using a statute apprach and a case approach. The result of this research is that a certificate issued by BPN is invalid on Public Facility land, especially Public Facility land located in a residential area because it is against Law No.1 of 2011 concerning Housing and Settlement Areas. And also regarding the illegality of a land certificate used as a public facility, as the judge's decision in this case is invalid, so the certificate of ownership rights is canceled with number: 9409 / Nagari Lingkuang Aua, in this case BPN employees are obliged to carry out their duties according to the regulations There is and it is better if a public facility is recorded in the land book, protected either physically by building public facilities, fenced in, or marked and also legally protected by certifying the land of the Public Facility.
