Tesis ini bertujuan untuk menganalisis implikasi putusan Mahkamah Konstitusi (MK) Nomor 35/PUU-XI/2013 terhadap hak budget Dewan Perwakilan Rakyat (DPR). Tesis ini membahas bagaimana implikasi putusan MK Nomor 35/PUU-XI/2013 terhadap hak budget dan fungsi anggaran DPR, dan bagaimana mereposisi hak budget DPR berdasarkan dengan putusan MK Nomor 35/PUU-XI/2013 sebagaimana diamanatkan Pasal 23 ayat (1) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 dan teori keuangan negara menurut Rene Stourm. Penelitian yang menggunakan pendekatan hukum normatif ini mengungkapkan wewenang DPR dalam memberikan persetujuan terhadap Anggaran Pendapatan Belanja Negara (APBN) dibatasi hanya sampai pada unit organisasi, fungsi, dan program. DPR memiliki hak budget sebagai hak yang mutlak dalam bentuk menerima atau menolak Rancangan APBN yang diajukan pemerintah. DPR sebagai representasi kedaulatan rakyat memiliki hak budget dan hak pengawasan. This thesis aims to analyze judgment the Constitutional Court Number 35/PUU-XI/2013 to reposition the right budget the House of Representatives. The thesis discussed how implication judgment the Constitutional Court Number 35/PUU-XI/2013 to reposition the right budget and function budget the House of Representatives, and how to reposition the right budget the House of Representatives based on the judgement the Constitution Court mandated article 23 paragraph 1 the Constitution of the Republic of Indonesia of 1945 and the theory of state budget according to Rene Stourm. This thesis uses normative legal approach. The thesis expresses authority the House of Representatives to provide approval to state budget restricted only up to organizational unit, function, and program. The House of Representatives has the right budget as a right absolute in the form of accept or reject a state budget proposed the government. The House of Representatives as representation sovereignty the people has the right budget and the right supervision. Hence, approval the House of Representatives to budget allocation other submitted to the government to guarantee the implementation of government and development to achieve a purpose state.
