Persoalan pengelolaan tanah di Indonesia berakar dari masa Hindia-Belanda. Salah satu departemen pemerintah yang mengaturnya adalah Departement van Binnenlandsch Bestuur pada 1866. Pengelolaan tanah khususnya proses kepemilikan tanah di Jawa merupakan salah satu tugas Departement van Binnenlandsch Bestuur. Penelitian ini membahas bagaimana proses kepemilikan tanah di Jawa, secara khusus proses sewa tanah kosong di Karesidenan Pasuruan, Jawa Timur. Penelitian ini menggunakan metode sejarah dengan menggunakan sumber primer berupa arsip Departement van Binnenlandsch Bestuur 1903-1911 koleksi ANRI yang dianalisis dengan menggunakan konsep birokrasi legal rasional dari Max Weber. Dari penelitian ini ditemukan bahwa dalam kepemilikan tanah ada yang dikenal dengan hak eigendom yaitu hak kepemilikan tanah milik pribumi dan hak erfpacht yaitu hak yang diperuntukkan untuk pihak swasta dapat menyewa tanah dalam jangka panjang. Proses permohonan hak sewa oleh pihak swasta dalam menyewa tanah di Jawa diatur oleh Departement van Binnenlandsch Bestuur yang memiliki peran kuasa untuk menindaklanjuti proses permohonan hak sewa sebelum permohonan itu diteruskan ke gubernur jenderal untuk disetujui. Dalam proses pengajuan permohonan sewa di Karesidenan Pasuruan, Jawa Timur, ditemukan berbagai kasus yang membuat Departement van Binnenlandsch Bestuur membatalkan perizinan sewa tanah.

The issue of land governance in Indonesia has occurred since the Dutch East Indies period. One of the government departments that managed land management was the Departement van Binnenlandsch Bestuur in 1866. Land administration, especially the procedure of land ownership in Java, is one of the duties of the Departement van Binnenlandsch Bestuur. This research explores the process of land ownership in Java, specifically the process of leasing vacant land in the Pasuruan Residency, East Java. This research utilizes the historical method by using primary sources in the form of archives of the Departement van Binnenlandsch Bestuur 1903-1911 from ANRI collection which is analyzed by using Max Weber's concept of rational legal bureaucracy. From this research it was found that in land ownership there is what is known as eigendom rights, which are rights for indigenous land ownership and erfpacht rights, which are rights intended for private parties to lease land in the long term. The procedure of applying for rent rights by private parties in leasing land in Java is regulated by the Departement van Binnenlandsch Bestuur, which is authorized to proceed with the process of applying for rent rights before the application is forwarded to the Governor-General for approval. In the process of applying for a lease in the Pasuruan Residency, East Java, various cases were found that made the Department van Binnenlandsch Bestuur cancel the land lease license.
