Pasal 235 ayat (1) dan Pasal 293 ayat (1) UUK-PKPU menyatakan bahwa tidak ada upaya hukum apapun yang dapat dilakukan terhadap Putusan PKPU. Pembatasan upaya hukum ini bertujuan untuk menjamin terpenuhinya asas kepastian hukum terhadap Kreditor dan berkaitan juga dengan sifat dari Forum PKPU yang berdimensi cepat (speedy trial). Namun, diterbitkannya Putusan MK Nomor 23/PUU-XIX/2021 menyebabkan dapat dilakukannya Kasasi sebagai upaya hukum atas Putusan PKPU dengan (2) syarat, yakni permohonan PKPU harus diajukan oleh Kreditor dan rencana perdamaian dari Debitor ditolak oleh Kreditor. Kasasi berfungsi untuk melindungi Debitor dari Kreditor yang memiliki niat jahat yang dengan sengaja mempailitkan Debitor melalui Forum PKPU dan sebagai mekanisme kontrol bilamana terjadi kekeliruan atau kesalahan penerapan hukum oleh Hakim pada pengadilan tingkat bawah. Penulis menggunakan metode yuridis-normatif dengan penelitian analisis-deskriptif melalui pendekatan kualitatif dan melakukan analisis terhadap permasalahan yang ada berdasarkan ketentuan yang berlaku. Hasil dari penelitian ini adalah didapatkan kesimpulan bahwa MK tidak memiliki tujuan untuk mengesampingkan ketentuan mengenai upaya hukum Putusan PKPU dalam UUK-PKPU, melainkan suatu upaya untuk melakukan progresivitas hukum atas upaya hukum Putusan PKPU di Indonesia dimana Forum PKPU banyak dijadikan sebagai strategi bisnis yang tidak sehat.

Article 235 paragraph (1) and Article 293 paragraph (1) of UUK-PKPU state that no legal action can be taken against the PKPU Decision. This limitation of legal remedies aims to ensure the fulfilment of the principle of legal certainty for Creditors and is also related to the nature of the PKPU Forum which has a speedy trial dimension. However, the issuance of Constitutional Court Decision No. 23/PUU-XIX/2021 resulted in the possibility of Cassation as a legal remedy for PKPU decisions with (2) conditions, namely that the PKPU application must be submitted by a Creditor and the Debtor's peace plan is rejected by the Creditor. Cassation serves to protect the Debtor from malicious creditors who deliberately bankrupt the Debtor through the PKPU Forum and as a control mechanism in the event of errors or misapplication of law by Judges at the lower court level. The author uses the juridical-normative method with descriptive-analytical research through a qualitative approach and analyses the existing problems based on the applicable provisions. The result of this research is the conclusion that the Constitutional Court does not have the aim to override the provisions regarding legal remedies for PKPU Decision in UUK-PKPU, but rather an effort to make legal progressivity on legal remedies for PKPU Decision in Indonesia where PKPU Forum is widely used as an unhealthy business strategy.
