Fenomena tuntutan masyarakat untuk mengetahui rekam jejak seorang pejabat publik, mulai mencuat sebagai salah satu dampak dari agenda reformasi tahun 1998. Komisi Yudisial dengan kewenangan mengusulkan pengangkatan hakim agung melakukan inisiatif untuk melakukan seleksi rekam jejak sebagai salah satu tahapan yang menentukan kelayakan seseorang untuk menjabat seorang hakim agung. Disebut sebagai “benteng terakhir” pencari keadilan di Mahkamah Agung memiliki fungsi sentral yang mendapat sorotan publik. Penelitian ini bertujuan untuk mengidentifikasi bagaimana Komisi Yudisial melakukan pengaturan hingga implementasi akan seleksi sebuah rekam jejak sebagai sebuah indikator yang akan mempengaruhi kelulusan calon hakim agung untuk diusulkan kepada Dewan Perwakilan Rakyat. Penelitian ini disusun dengan metode sosiolegal yang merupakan sebuah kombinasi tidak hanya terbatas pada studi doktrinal, namun termasuk dengan studi non-doktrinal terkait sebuah fenomena hukum dalam sebuah arena sosial tertentu. Dalam praktiknya, terdapat faktor-faktor non hukum yang mempengaruhi eksistensi seleksi rekam jejak calon hakim agung. Penulis menguraikan hasil penelitian dari aspek peraturan, aspek lembaga rekrutmen (dalam hal ini Komisi Yudisial), serta aspek motivasi masyarakat yang memiliki kontribusi besar pada sebuah seleksi rekam jejak calon hakaim agung. Penelitian akan fokus menggali tiga unsur kualifikasi, validasi, serta motivasi yang terkait dengan sebuah seleksi rekam jejak.

The phenomenon of public demand to know the track record of the public officials began to emerge as one of the impacts of the reform agenda in 1998. The Judicial Commission, with the auhority to propose the appointment of Supreme Court Justices, has taken the initiative to carry out track record selection as one of the phase in determining a person’s suitability to serve as a Supreme Court Justice. Referred to the “last bastion” for the justice seekers in the Supreme Court, Supreme Court Justice has a central function that related to the public attention. This research aims to identify how the Judicial Commission regulates and implements the selection of a track record as an indicator that will take affect to the graduation of the candidates for Supreme Court Justice to be proposed to the House of Representatives. This research was conducted with a sociolegal method which is a combination not only limited to doctrinal studies, but also includes non-doctrinal studies related to a legal phenomenon in a particular social arena. In practice, there are non-legal factors that incfluence the existence of track record selection for candidates for Supreme Court Justices. The author elaborates the research results from the regulatory aspect, the recruitment agency aspect (in this case the Judicial Commission), as well as the society motivation aspect which has a major contribution to the selection of the track record of candidates for Supreme Court Justices. The research will focus on exploring the three elements of qualification, validation and motivation related to the track record selection.
