Untuk memberikan kepastian akan keabsahan kepemilikan hak penguasaan atas tanah maka dilakukan kegiatan pendaftaran tanah secara seksama oleh pemerintah agar data yang disampaikan dapat dipertangungjawabkan kebenarannya. Selalu ada kemungkinan digugat oleh pihak lain yang dapat membuktikan bahwa dialah pemilik hak penguasaan atas tanah yang sebenarnya. Kasus semacam itu ditemukan dalam Putusan Mahkamah Agung Nomor 309PK/Pdt/2021. Penelitian ini dimaksudkan untuk menganalisis penentuan pemilik sertipikat hak penguasaan atas tanah yang sebenarnya dengan terbitnya sertipikat ganda Hak Milik di atas bidang tanah yang sama, dan penguatan lembaga rechverwerking melalui putusan Peninjauan Kembali (PK) yang menolak permohonan pemilik sertipikat yang terbit kemudian sebagai dasar pembatalan sertipikat oleh kantor pertanahan. Penelitian hukum doktrinal ini dilakukan untuk mengumpulkan data sekunder yang selanjutnya dianalisis secara kualitatif. Dari hasil analisis dapat dijelaskan bahwa penentuan kepemilikan sertipikat hak penguasaan atas tanah didasarkan pada pertimbangan bahwa nama yang tertera dalam sertipikat yang terbit terdahulu merupakan pemilik hak penguasaan atas tanah yang sebenarnya. Hal tersebut dikuatkan melalui Putusan Peninjauan Kembali yang menolak permohonan pemilik sertipikat yang terbit kemudian melalui lembaga rechtsverwerking atau kehilangan hak untuk menuntut. Selanjutnya, pemilik sertipikat yang terdahulu bisa melanjutkan proses untuk membatalkan sertipikat yang terbit kemudian melalui permohonan pembatalan ke kantor pertanahan setempat.

To ensure the validity of land ownership rights, the government conducts land registration carefully so that the data presented can be accounted for truthfully. There is always the possibility of being sued by others who can prove themselves as the actual landowners. Such cases can be found in Supreme Court Decision Number 309PK/Pdt/2021. This research aims to analyze the determination of the true owner of the land ownership certificate in cases of the issuance of duplicate Ownership Certificates for the same land plot, and to strengthen the institution of rechverwerking through a Review that rejects the application of the certificate owner issued later as the basis for the cancellation of the certificate by the land office. This doctrinal legal research is conducted to gather secondary data which is then analyzed qualitatively. The analysis results indicate that the determination of ownership of the land ownership certificate is based on the consideration that the name listed in the certificate issued earlier is the actual landowner. This is reinforced through the Review Decision which rejects the application of the certificate owner issued later through the rechtsverwerking institution or the loss of the right to sue. Subsequently, the owner of the certificate registered earlier can proceed with the process of canceling the certificate issued later through a cancellation request to the local land office.
