Tesis ini membahas tentang keabsahan Akta Pengikatan Jual Beli (APJB) menggunakan Kuasa Jual berdasarkan Putusan Pengadilan Negeri Bekasi Nomor 714/Pdt.G/2017/PN.Bks. Permasalahan yang diangkat adalah keabsahan Akta Pengikatan Jual Beli menggunakan kuasa jual serta pertimbangan Majelis Hakim dalam memutuskan perkara a quo. Metode Penelitian yang digunakan adalah yuridis normatif, dengan penelusuran data sekunder dari berbagai dokumen sumber hukum primer, sekunder dan tersier. Pendekatan yang digunakan kualitatif dengan tipologi penelitian eksplanatoris analitis. Hasil penelitian menyatakan bahwa bilamana kuasa jual tidak disertai dengan perjanjian pokoknya atau berdiri sendiri maka kuasa jual tersebut tidaklah sah. APJB yang ditandatangani antara Penjual AM dan Pembeli MFW harusnya dapat dimintakan pembatalan karena Penjual AM bertindak dengan kuasa jual yang tidak sah. Tidak sahnya kuasa jual menyebabkan Penjual AM tidak cakap untuk bertindak dalam APJB, sehingga salah satu syarat subyektif tidak terpenuhi yaitu Pasal 1320 KUHPerdata Ayat (2) mengenai kecakapan bertindak seseorang dalam suatu perjanjian. Pertimbangan Majelis Hakim memutuskan perkara a quo merupakan perbuatan melawan hukum adalah karena tidak dilaksanakannya salah satu kewajiban oleh Penjual AM dalam APJB. Tidak dilaksanakannya salah satu kewajiban baik dalam APJB maupun perjanjian penyelesaian rumah, berdasarkan analisis merupakan suatu tindakan yang lebih memenuhi unsur wanprestasi dibandingkan perbuatan melawan hukumnya, hal ini sesuai dengan unsur pertama wanprestasi yaitu “tidak melakukan suatu kewajiban yang telah disanggupi untuk dilakukannya”.

This thesis discussing the validity of the Sale and Purchase Agreement Deed (“APJB”) using a power of attorney to sell pursuant to the Bekasi District Court Decision Number 714/Pdt.G/2017PN.Bks. The issues that being raised in this thesis are the legal consequences of the sale and purchase agreement that using a power of attorney to sell and the consideration of the panel judges in giving award on a quo case. The method of this thesis using juridical normative, with researching secondary data from various legal source documents such as primary, secondary and tertiary. This thesis using qualitative approach and analytical descriptive type. The result of this research shows that the power of attorney to sell is null and void by law if it didn’t come hand-in-hand with the agreement of the Conditional Sale and Purchase.  The APJB signed by the AM as a Seller and the MFW as a Buyer should be repealed because the seller acting based on the invalid power of attorney to sell. The invalidity of the power of attorney to sell causing the Am as Seller is incompetent in signing APJB, thus the subjective requirements which namely in Article 1320 of the Civil Code Paragraph (2) regarding “the capacity to conclude an agreement” is not fulfilled. The consideration of the panel judge in giving award on the a quo case is tort because the seller not fulfilling one of its obligation in APJB. By no fulfilling the obligation under the APJB, it will be considered as default instead of tort, it is in accordance with the first element of default, which is “do not conducting an obligation that been agreed”.
