 Abstract

Pengaturan mengenai pelaksanaan peraturan perundang-undangan seharusnya diatur secara tuntas dalam sebuah Peraturan Presiden dan tidak diatur lagi dalam sebuah Peraturan Menteri. Peraturan Presiden dalam hal ini memiliki efektifitas, daya mengikat, dan keberlakuan yang lebih kuat dalam hierarki peraturan perundang-undangan di Indonesia dari pada Peraturan Menteri yang pada dasarnya bukan bagian dari hierarki peraturan perundang-undangan, sehingga tanpa adanya Peraturan Menteri pun, seluruh kebijakan Pemerintah yang telah diatur dalam Peraturan Presiden dapat langsung efektif dilaksanakan. Penelitian ini diharapkan dapat memberikan rekomendasi bagi penyelesaian ketidakjelasan posisi Peraturan Menteri dalam hierarki peraturan perundang-undangan Indonesia dengan didukung oleh dasar juridis dan teoritis yang lebih kuat sekaligus mencoba mencari jawaban atas pertanyaan: dapatkah Peraturan Menteri benar-benar ditiadakan dalam sistem hukum nasional sebagai solusi permasalahan over regulasi di Indonesia sehingga menjadikan Peraturan Presiden sebagai peraturan pelaksana Undang-Undang dan/atau Peraturan Pemerintah tingkat pusat paling akhir yang memang menjadi bagian dari hierarki peraturan perundang-undangkan.

Regulations regarding the implementation of laws and regulations should be thoroughly regulated in a Presidential Regulation and no longer regulated in a Ministerial Regulation. Presidential Regulations in this case have stronger effectiveness, binding power, and enforceability in the hierarchy of laws and regulations in Indonesia than Ministerial Regulations which are basically not part of the hierarchy of laws and regulations, so that even without a Ministerial Regulation, all Government policies that have been regulated in the Presidential Regulation can be directly implemented effectively. This research is expected to provide recommendations for resolving the unclear position of the Ministerial Regulation in the hierarchy of Indonesian laws and regulations, supported by a stronger juridical and theoretical basis as well as trying to find answers to the question: can the Ministerial Regulation really be eliminated in the national legal system as a solution to the problem of over regulation in Indonesia so as to make the Presidential Regulation the implementing regulation of Laws and/or Government Regulations at the latest central level which are indeed part of the hierarchy of statutory regulations.
