Pengusahaan sumber daya air saat ini semakin marak sejalan dengan pertumbuhan pendudukan serta pemenuhan kebutuhan air terhadap masyarakat. Para pelaku usaha yang melakukan pengusahaan air untuk menunjang proses produksinya seharusnya memiliki izin pengusahaan air untuk memastikan terciptanya perlindungan negara terhadap hak rakyat atas air. Hal ini disebabkan pendaftaran perizinan pengusahaan air oleh para pelaku usaha memberikan pengawasan serta pengontrolan negara atas air yang bersifat mutlak, sehingga dapat memberikan perlindungan terhadap masyarakat dalam pemenuhan kebutuhan airnya. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan aturan undang-undang serta penelusuran kepustakaan juga didukung oleh data instansi serta kementerian yang mempunyai kewenangan dalam hal penegakan hukum serta pelaksanaan perizinan pengusahaan sumber daya air. Penelitian membahas keberlanjutan peraturan perundang-undangan terkait perizinan pengusahaan sumber daya air pasca Putusan MK Nomor: 85/PUU-XI/2013. Penegakan hukum terhadap pelanggar perizinan pengusahaan sumber daya air dan perlindungan masyarakat dalam pemenuhan kebutuhan airnya juga dibahas dalam penelitian ini. Belum maksimalnya pengawasan perizinan pengusahaan sumber daya air terhadap para pelaku usaha, merupakan faktor yang mempengaruhi efektivitas perizinan pengusahaan sumber daya air. Hal tersebut membuat celah bagi para pelaku usaha untuk tidak terlebih dahulu mendaftarkan izin pengusahaan sumber daya air sesuai dengan ketentuan undang-undang yang berlaku. Dalam hal ini, perlindungan masyarakat atas hak terhadap air perlu dipertegas.

The exploitation of water resources is currently increasingly widespread in line with the rate of population growth and meeting the water needs of the community. Business actors who carry out water exploitation to support the production process should have a water concession permit to ensure the creation of state protection for the people's right to water. This is because the registration of water concessions by business actors provides absolute state supervision and control over water, so that it can provide protection to the community in meeting their water needs. This research uses normative legal research through a statutory regulatory approach with literature searches supported by data from agencies and ministries that have authority in terms of law enforcement and the implementation of water resources exploitation permits. The study discusses the sustainability of legislation related to licensing of water resources after the Constitutional Court Decision Number: 85/PUU-XI/2013. Law enforcement against violators of water resources exploitation permits and community protection in meeting their water needs are also discussed in this study. The lack of maximum supervision in terms of licensing for water resources exploitation for business actors is a factor that affects the effectiveness of licensing for water resources exploitation. This creates a gap for business actors not to first register a water resource exploitation permit in accordance with the provisions of the applicable law. In this case, the community's protection of the right to water needs to be emphasized.
