Penelitian ini membahas mengenai jual beli tanah yang dilakukan secara lisan di bawah tangan tanpa menggunakan Akta Jual Beli (AJB) yang dibuat oleh Pejabat Pembuat Akta Tanah (PPAT) sebagai alat bukti autentik terjadinya perbuatan hukum jual beli tanah. Sebagai akibatnya, pihak pembeli tidak dapat melakukan balik nama sertipikat hak milik atas tanah di Kantor Pertanahan karena pihak penjual sudah tidak diketahui alamat dan keberadaannya. Adapun permasalahan yang diangkat dalam penelitian ini adalah mengenai pendaftaran peralihan hak atas tanah karena jual beli tanah di bawah tangan yang dilakukan secara hukum adat, selain itu mengenai kekuatan pembuktian dokumen transaksi pada jual beli di bawah tangan tanpa kehadiran dan keterangan dari penjual atau pemilik nama Sertipikat Hak Milik atas tanah. Untuk menjawab permasalahan tersebut digunakan metode penelitian yuridis normatif dengan menggunakan pendekatan perundang-undangan dan pendekatan kasus dengan tipologi penelitian eksplanatoris. Hasil analisis yang diperoleh dalam penelitian ini adalah bahwa proses pendaftaran tanah dilakukan dengan hasil putusan pengadilan yang telah berkekuatan hukum tetap yang diawali dengan pengajuan gugatan di pengadilan negeri. Adapun pembuktian dokumen transaksi pada jual beli lisan tanpa AJB dan tanpa keterangan pihak penjual dapat diperkuat dengan alat bukti saksi, terutama kesaksian dari kepala persekutuan.

This study discusses the sale and purchase of land which is carried out orally under the hand without using the Sale and Purchase Deed (AJB) made by the Land Deed Making Officer (PPAT) as authentic evidence of the occurrence of legal acts of buying and selling land. As a result, the buyer cannot change the name of the certificate of title to the land at the Land Office because the seller's address and whereabouts are unknown. The problems raised in this study are regarding the registration of the transfer of land rights due to the sale and purchase of land under the hands of customary law, in addition to the power of proof of transaction documents in buying and selling under the hands without the presence and information of the seller or the owner of the certificate name. Ownership of land. To answer these problems, a normative juridical research method is used using a statutory approach and a case approach with an explanatory research typology. The results of the analysis obtained in this study are that the land registration process is carried out with the results of court decisions that have permanent legal force starting with filing a lawsuit in the district court. The proof of transaction documents in oral buying and selling without AJB and without information from the seller can be strengthened by witness evidence, especially testimony from the head of the partnership.
