Perkembangan teknologi blockchain salah satunya smart contract pada platform Ethereum, yang tersedia pada website Etherscan sering kali memuat klausula baku, salah satunya klausula baku pilihan hukum atau choice of law, yang menetapkan hukum dan yurisdiksi sesuai preferensi pengembang. Apabila terjadi sengketa, klausula baku choice of law ini menjadi tantangan sebab sering kali tidak mengakomodasi kepentingan pengguna dari yurisdiksi berbeda. Di Indonesia, Pasal 18A UU No. 1 Tahun 2024 menetapkan bahwa kontrak elektronik internasional harus tunduk pada hukum Indonesia. Penelitian ini mengkaji bagaimana UU No. 1 Tahun 2024 memberikan pelindungan hukum dalam sengketa terkait klausula baku choice of law dalam smart contract serta bagaimana UU No.1 Tahun 2024 memberikan pelindungan konsumen atas penggunaan klausula baku choice of law yang tidak selaras dengan asas kebebasan berkontrak. Penelitian ini menggunakan jenis penelitian doktrinal dengan sumber data sekunder serta analisis data deskriptif kualitatif. Hasil penelitian menunjukkan UU No. 1 Tahun 2024 perlu adanya peraturan tentang proses pelaksanaan sengketa mengetahui benturan yurisdiksi yang sering terjadi dalam sengketa lintas negara, yang berujung tidak pulihnya hak konsumen. Penelitian ini menemukan bahwa implementasi dari UU No. 1 Tahun 2024 dalam melindungi konsumen pada dasarnya tepat sasaran, asas kebebasan berkontrak yang sejatinya dibatasi harus dapat diterima oleh konsumen Indonesia.

The development of blockchain technology, one of which is the smart contract on the Ethereum platform, which is available on the Etherscan website, often contains standard clauses, one of which is the choice of law standard clause, which determines the law and jurisdiction according to the developer's preferences. If a dispute occurs, this standard choice of law clause becomes a challenge because it often does not accommodate the interests of users from different jurisdictions. In Indonesia, Article 18A of Law no. 1 of 2024 stipulates that international electronic contracts must comply with Indonesian law. This research examines how Law no. Law No. 1 of 2024 provides legal protection in disputes related to standard choice of law clauses in smart contracts and how Law No. 1 of 2024 provides consumer protection for the use of standard choice of law clauses that are not in line with the principle of freedom of contract. This research uses doctrinal research with secondary data sources and qualitative descriptive data analysis. The research results show that Law no. 1 of 2024, it is necessary to have regulations regarding the dispute implementation process, recognizing the clash of jurisdictions that often occur in cross-border disputes, which result in consumer rights not being restored. This research found that the implementation of Law no. 1 of 2024 in protecting consumers is basically right on target, the principle of freedom of contract which is actually limited must be accepted by Indonesian consumers.
