Kecelakaan lalu lintas di Indonesia terus meningkat, menyebabkan kerugian besar bagi masyarakat. Jasa Raharja, melalui Undang-Undang No. 33 dan 34 Tahun 1964, memberikan jaminan sosial untuk korban kecelakaan. Studi kasus kecelakaan KM 58 Tol Jakarta-Cikampek menyoroti tantangan dalam tanggung jawab Jasa Raharja, khususnya terkait kendaraan travel tidak resmi, dan pentingnya perlindungan hukum yang lebih baik. Penelitian ini menggunakan metode yuridis-normatif dengan tipologi deskriptif-analitis. Menggunakan Data sekunder yang berupa bahan hukum primer (peraturan perundang-undangan), sekunder (buku, jurnal), dan tersier (kamus). Pengumpulan data melalui studi kepustakaan dan wawancara narasumber. Analisis dilakukan secara kualitatif untuk mengevaluasi efektivitas layanan Jasa Raharja, kinerja klaim, dan sinkronisasi hukum terkait kecelakaan lalu lintas. Jasa Raharja bertugas mengelola Dana Kecelakaan berdasarkan UU No. 33 dan 34 Tahun 1964, memberikan santunan kepada korban kecelakaan transportasi umum dan pihak ketiga. Penumpang travel GranMax tetap berhak atas santunan jika dianggap korban kecelakaan, meskipun tidak resmi, kecuali terbukti sebagai penyebab utama kecelakaan. Santunan juga dapat diberikan melalui jalur ex gratia sebagai bentuk empati dan tanggung jawab moral. Pemerintah perlu merevisi PMK No. 15 dan 16/2017 agar besaran santunan sesuai inflasi dan kebutuhan korban kecelakaan. Jasa Raharja harus meningkatkan transparansi, mempercepat klaim, dan menyederhanakan prosedur. Masyarakat memerlukan edukasi menyeluruh tentang hak-hak mereka, prosedur klaim, serta perlindungan hukum untuk memastikan keadilan dalam pertanggungan kecelakaan lalu lintas.
Traffic accidents in Indonesia are constantly increasing, causing huge losses to society. Jasa Raharja, based on Laws No. 33 and 34 of 1964, provides social security for accident victims. The case study of the KM 58 Tol Jakarta-Cikampek accident highlights the challenges in Jasa Raharja's responsibilities, especially regarding unofficial travel vehicles, and the importance of better legal protection. This research uses a juridical-normative method with descriptive-analytical typology. It used secondary data in the form of primary (laws and regulations), secondary (books, and journals), and tertiary (dictionaries) legal materials. The data was collected through literature study and interviews with sources. The analysis is carried out qualitatively to evaluate the effectiveness of Jasa Raharja's services, claim performance, and synchronization of laws related to traffic accidents. Based on Laws No. 33 and 34 year 1964, jasa raharja is responsible for managing the Accident Fund used for giving compensation to both the victims of public transportation accidents and the third parties. Therefore, although not declared officially, the passengers of Granmax are entitled to compensation as they are considered to be victims of the traffic accident until they are proven to be the main cause of the accident. Compensation can also be provided through the ex gratia program as a form of empathy and moral responsibility. The government needs to amend PMK No. 15 and 16/2017 so that the amount of compensation is in line with inflation and the needs of accident victims. Jasa Raharja must improve transparency, speed up claims, and simplify procedures. The public needs comprehensive education on their rights, claim procedures, and legal protection to ensure justice in traffic accident coverage.
