 Abstract

Tulisan ini menganalisis dua rumusan masalah utama, yakni: kondisi existing sistem seleksi hakim konstitusi Indonesia ditinjau dari pengaturan Pasal 24C UUD NRI Tahun 1945; serta bagaimana proyeksi ideal seleksi hakim konstitusi kedepannya. Dengan menggunakan metode penelitian doktrinal dengan pendekatan perundang-undangan dan perbandingan negara. Hasil penelitian menunjukkan bahwa dengan ketiadaan standar baku seleksi menjadikan sistem seleksi hakim konstitusi tidak secara transparan, akuntabel dan partisipatif. Sehingga prosesnya akrab dengan nuansa politik yang berujung pada kondisi hakim yang tidak independen dan imparsial dalam menjalankan fungsinya (sebagaimana kecenderungan hakim dalam memutus perkara dan pelanggaran kode etik oleh hakim). Dikarenakan saat proses rekrutmen hakim dijadikan sebagai moemntum embaga pengusung untuk mengintervensi kekuasaan kehakiman, maka pembentukan panitia ad hoc menjadi pilihan ideal dalam merekrut hakim konstitusi. Selain mempertegas teori pemisahan kekuasaan dengan peran politik yang dibatasi, sistem rekrutmen akan berjalan dengan terbuka dan akuntabel. Sebagaimana dijalankan oleh negara komparasi yakni Afrika Selatan, Zambia, dan Ekuador. Ketiga negara tersebut, menrapkan sistem seleksi dengan lembaga khusus bernama Judicial Service Commission.

This paper analyzes two main problem as formulations, those are: the existing condition of Indonesian constitutional judge selection system in terms of the regulation of Article 24C of the 1945 Constitution of the Republic of Indonesia; and how the ideal projection of the contitutional judge’s selection in future. This study uses doctrinal research methods with a statutory and comparative state approach. The results shows that the absence of selection standards made the selection system of constitutional judges not transparent, accountable and participatory. So that the process is lead into political nuances which lead to the condition of judges who are not independent and impartial in carrying out their functions (as the tendency of judges in deciding cases and violations of the code of ethics by judges). Thus, when the recruitment process of judges is used as a momentum for the supporting institutions to intervene in judicial power, the formation of an ad hoc committee is the ideal choice in recruiting constitutional judges. In addition to reinforcing separation of powers with a limited political role’ theory, the recruitment system goes openly and accountably. As used by comparative countries as South Africa, Zambia and Ecuador. Those countries apply a selection system with a special institution called the Judicial Service Commission.
