 Abstract

Dalam hukum perdata Indonesia, asas itikad baik diatur secara eksplisit pada tahap pelaksanaan perjanjian sebagaimana tercantum dalam Pasal 1338 ayat (3) Kitab Undang-Undang Hukum Perdata. Namun, penerapannya pada tahap pra kontrak masih belum diatur secara jelas, sehingga hal ini dinilai menimbulkan kekosongan hukum ketika salah satu pihak bertindak tanpa itikad baik sebelum perjanjian mengikat. Berbeda dengan itu, sistem hukum Australia yang menganut tradisi common law menerapkan doktrin promissory estoppel sebagai mekanisme perlindungan hukum dalam tahap pra kontrak. Doktrin ini memberikan hak ganti rugi bagi pihak yang dirugikan akibat janji yang ditarik. Penelitian ini bertujuan untuk membandingkan asas itikad baik pada tahap pra kontrak di Indonesia dengan doktrin promissory estoppel di Australia, baik dari segi teori maupun penerapannya dalam praktik hukum. Penelitian ini dilakukan dengan pendekatan komparatif dalam bentuk doktrinal dan sumber hukum sekunder.

In Indonesian civil law, the principle of good faith is explicitly regulated at the stage of implementing an agreement as stated in Article 1338 paragraph (3) of the Civil Code. However, its application at the pre-contract stage is still not clearly regulated, so this is considered to create a legal exception when one party acts without good faith before the agreement is binding. In contrast, the Australian legal system, which adheres to the common law tradition, applies the doctrine of promissory estoppel as a legal protection mechanism at the pre-contract stage. This doctrine provides the right to compensation for parties who are harmed due to a promise that is withdrawn. This research aims to compare the principle of good faith at the pre-contract stage in Indonesia with the doctrine of promissory estoppel in Australia, both in terms of theory and its application in legal practice. This research was conducted using a comparative approach in the form of doctrine and secondary legal sources.
