 Abstract

Penjaminan benda bergerak di Indonesia diatur melalui Kitab Undang-Undang Hukum Perdata untuk gadai dan melalui Undang-Undang Nomor 42 Tahun 1999 Tentang Jaminan Fidusia. Meskipun secara konsep gadai dan fidusia yang dikenal di Indonesia tidak berbeda jauh dengan konsep possessory dan non-possessory pledge yang dikenal di Belanda dan Prancis, namun ketiganya memiliki pendekatan dan struktur hukum yang berbeda. Pada sistem hukum Belanda dan Prancis juga terdapat pilihan alternatif lainnya yang dapat menjadi pilihan dalam menjaminkan benda bergerak. Sistem Belanda dan Prancis mengatur jaminan dengan lebih efisien melalui mekanisme pengaturan yang terpusat dan eksekusi yang lebih rinci. Di sisi lain, Indonesia masih menghadapi hambatan struktural, termasuk lemahnya sistem pendaftaran dan perlindungan hukum dalam eksekusi. Melalui penelitian ini dapat diketahui bentuk penjaminan benda bergerak yang telah diterapkan oleh ketiga negara terkait yang paling efektif dan memiliki cakupan perlindungan yang paling luas.

Security over movable assets in Indonesia is regulated through the Indonesia Civil Code for pledge and through Law No. 42 of 1999 on Fiduciary Security. Although, conceptually, the pledge and fiduciary security in Indonesia are not much different from the possessory and non-possessory pledge concepts in the Netherlands and France, the three systems have different approaches and legal structures. In the legal systems of the Netherlands and France, there are also alternative options that could be considered for securing movable assets. The Dutch and French systems regulate security more efficiently through centralized regulation and detailed mechanism for execution process. On the other hand, Indonesia still faces structural obstacles, including weak registration and limited enforcement. This research aims to identify which form of security over movable assets, applied by the three countries in question, is the most effective and provides the broadest scope of protection.
