Kehadiran Undang-Undang Persaingan usaha sebagai produk reformasi membuka peluang investasi asing ke Indonesia seperti Grab Indonesia yang kemudian menjalin perjanjian kerja sama dengan PT TPI. Perjanjian ini mengakibatkan Grab dan TPI dijatuhi putusan KPPU Nomor 13/KPPU-I/2019 dan melahirkan tujuan penulisan skripsi ini terkait upaya keberatan apa yang diajukan Grab dan TPI serta bagaimana dalil cacat prosedur dapat membatalkan putusan KPPU secara studi doktrinal. Kasus ini menunjukkan betapa pentingnya pemahaman akan hukum acara untuk meminimalisir kemungkinan terjadinya cacat prosedur yang berakibat pada pembatalan putusan KPPU. Tidak hanya itu, kasus ini juga menunjukkan berbagai upaya hukum yang dapat dilakukan apabila pihak terlapor ataupun KPPU merasa dirugikan dengan adanya kasus tersebut. Oleh karena itu, diperlukan penanganan yang lebih efektif berupa pemahaman hukum acara yang memadai, integrasi penafsiran hukum antar institusi, dan pengaturan yang terbaharukan untuk menjamin kepastian hukum serta iklim persaingan usaha yang sehat. Untuk itu, penelitian ini dilakukan secara doktrinal untuk menganalisis putusan KPPU, dugaan cacat prosedur yang menjadi alasan Grab Indonesia dan PT TPI mengajukan upaya keberatan, dan upaya kasasi KPPU atas putusan keberatan tersebut. Hasil analisis menunjukkan adanya berbagai dugaan cacat prosedur berupa pelanggaran kode etik, contempt of court, dan dugaan pelanggaran asas Audi et Alteram Partem.

The existence of the Competition Law as a product of reform opens up opportunities for foreign investment into Indonesia such as Grab Indonesia which then enters into a cooperation agreement with PT TPI. This agreement resulted in Grab and TPI being sentenced to KPPU Decision Number 13/KPPU-I/2019 and led to the purpose of writing this thesis related to appeals submitted by Grab and TPI and how the argument of procedural defects can cancel KPPU decisions in doctrinal studies. This case shows the importance of understanding procedural law to minimize the possibility of procedural defects that result in the annulment of KPPU's decision. Not only that, this case also shows various legal remedies that can be taken if the reported party or KPPU feels aggrieved by the case. Therefore, a more effective handling is needed in the form of an adequate understanding of procedural law, integration of legal interpretations between institutions, and updated regulations to ensure legal certainty and a healthy business competition climate. For this reason, this study is conducted doctrinally to analyse the KPPU's decision, the alleged procedural defects that became the reason Grab Indonesia and PT TPI filed an objection, and the KPPU's cassation appeal against the objection decision. The results of the analysis show that there are various alleged procedural defects in the form of violations of the code of ethics, contempt of court, and alleged violations of the Audi et Alteram Partem principle.
