Pidana kerja sosial merupakan bentuk pemidanaan pokok yang baru diakomodasi dalam sistem hukum pidana Indonesia melalui Kitab Undang-Undang Hukum Pidana (KUHP) Tahun 2023 sebagai suatu pidana alternatif. Pidana ini hadir sebagai respons terhadap permasalahan overcapacity lembaga pemasyarakatan dan sebagai wujud pergeseran paradigma pemidanaan ke arah yang lebih rehabilitatif dan humanis. Skripsi ini bertujuan untuk mengkaji pengaturan dan prosedur eksekusi pidana kerja sosial dalam sistem hukum Indonesia, menganalisis perbandingannya dengan sistem hukum Belanda yang telah terlebih dahulu menerapkan model serupa (taakstraf), serta mengevaluasi potensi penerapan model Belanda di Indonesia. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan komparatif. Hasil penelitian menunjukkan bahwa meskipun pidana kerja sosial telah diatur secara substantif dalam KUHP Nasional, pelaksanaannya masih menghadapi berbagai kendala struktural, kelembagaan, dan regulatif akibat belum tersedianya aturan teknis yang komprehensif. Sementara itu, Belanda telah memiliki sistem pelaksanaan taakstraf yang matang, terstruktur, dan didukung lembaga pelaksana independen (Reclassering Nederland). Oleh karena itu, Indonesia perlu memperkuat kerangka regulasi, meningkatkan kapasitas Balai Pemasyarakatan, dan membangun sinergi antar aparat penegak hukum agar pidana kerja sosial dapat menjadi bentuk pemidanaan yang efektif, adil, dan berorientasi pada reintegrasi sosial.

Community service punishment is an alternative penal sanction newly accommodated in the Indonesian criminal justice system through the enactment of the Criminal Code (KUHP) of 2023. This sanction emerges as a response to the issue of prison overcapacity and as part of a paradigm shift in penal policy towards a more rehabilitative and humanistic approach. This thesis aims to examine the regulation and implementation of community service punishment in Indonesia, analyze its comparison with the Dutch legal system—which has long implemented a similar model known as taakstraf—and assess the potential adaptation of the Dutch model in Indonesia. The research employs a normative legal method with a comparative approach. The findings indicate that although community service punishment has been substantively regulated under the 2023 Criminal Code, its implementation still faces various structural, institutional, and regulatory challenges due to the absence of comprehensive technical regulations. Meanwhile, the Netherlands has developed a mature and structured taakstraf system, supported by an independent executing body (Reclassering Nederland). Thus, Indonesia must strengthen its regulatory framework, enhance the institutional capacity of the Correctional Centers (Balai Pemasyarakatan), and build effective coordination among law enforcement agencies in order for community service punishment to become an effective, fair, and socially reintegrative penal mechanism.
