Pegawai Negeri Sipil sebagai unsur aparatur negara wajib memberikan contoh yang baik kepada bawahannya dan menjadi teladan sebagai warga negara yang baik dalam masyarakat. Pegawai Negeri Sipil juga harus menjadi teladan dalam tingkah laku, tindakan dan ketaatan kepada peraturan perundang-undangan yang berlaku. PP Izin Perkawinan dan Perceraian PNS mengatur bahwa apabila perceraian terjadi atas kehendak Pegawai Negeri Sipil pria, maka Pegawai Negeri Sipil tersebut wajib menyerahkan sebagian gajinya untuk penghidupan bekas istri dan anak-anaknya. Berdasarkan kasus yang ditemukan, telah terjadi perceraian yang mana pihak Penggugat (suami) dan Tergugat (istri) adalah Pegawai Negeri Sipil. Perceraian tersebut telah berkekuatan hukum tetap sebagaimana yang telah diputuskan Pengadilan Negeri Jakarta Pusat. Pasca putusan pengadilan tersebut, Pegawai Negeri Sipil pria yang bersangkutan tidak memenuhi kewajiban sebagaimana yang diputuskan dengan tidak memberikan nafkah kepada anak dan mantan istri setiap bulannya sebesar yang telah diputuskan hakim yang didasari karena pembayaran pemotongan gaji sesuai yang diperintahkan oleh putusan pengadilan tidak bisa secara otomatis dikirim ke rekening mantan istri. Adapun permasalahan yang diangkat dalam penelitian ini adalah upaya kepegawaian yang dapat dilakukan pejabat (atasan) dari instansi tempat Pegawai Negeri Sipil bekerja atas tuntutan dari mantan istri guna pemenuhan putusan pengadilan, dan penegakan disiplin bagi Pegawai Negeri Sipil yang tidak melaksanakan putusan pengadilan terkait biaya penghidupan anak dan mantan istri akibat perceraian. Untuk menjawab permasalahan tersebut digunakan metode penelitian hukum yuridis normartif dan analisa data menggunakan metode eksplanatori. Hasil analisa adalah bahwa upaya yang dapat dilakukan Pejabat (atasan) dari instansi tempat Pegawai Negeri Sipil bekerja atas tuntutan dari mantan istri guna pemenuhan putusan pengadilan adalah dengan memerintahkan kepada Bendahara instansi untuk melakukan pembagian gaji Pegawai Negeri Sipil bersangkutan sesuai dengan putusan pengadilan dan Penegakan disiplin bagi Pegawai Negeri Sipil yang tidak melaksanakan putusan pengadilan dapat dijatuhi salah satu hukuman disiplin berat berdasarkan PP Disiplin PNS.

Civil Servants as an element of state apparatus should be a good role model to their subordinates and be an example as a good citizen in society. Civil Servants should also be an example in conduct, actions and adherence to the prevailing laws and regulations. Government Regulation on Marriage Licenses and Divorce Civil Servants stipulates that if the divorce occurs at the will of the male Civil Servant, then the Civil Servant is obliged to give up a portion of his salary for the expense of his ex-wife and children. Based on the case found, there has been a divorce in which the Plaintiff (husband) and Defendant (wife) are Civil Servants. The divorce has a permanent legal force as decided by the Central Jakarta District Court. After the court's decision, the male Civil Servant in question did not fulfill the obligation as decided by not giving an expense to the child and ex-wife every month as much as the judge had decided because the income deduction payment as ordered by the court decision cannot be automatically sent to the ex-wife's account. The issues raised in this study are about the efforts that can be made by officials (superiors) of the agency where civil servants work on demands from ex-wives in order to fulfill court decisions, and discipline enforcement for Civil Servants whom not execute the court decisions related to the cost of livelihood of children and ex-wives due to divorce. To answer the problem is used empirical juridical normative research methods and data analysis using the explanatory method. The analysis that the Officer (superior) of the male civil cervant for the demands of the ex-wife in order to fulfill the court's decision is to order the financial manager to distribute the salary of the male civil servant in accordance with the court's decision and the enforcement of discipline for civil servants whom not execute the court's decision can be sentenced to one of the severe disciplinary penalties based on Government Regulations on Civil Servant Discipline.
