"ABSTRAK
A program titled "Operation Valkyrie" and implemented by the Illinois State Police for the purpose of interdicting drugs is presented as a study that illustrates reciprocity between a police organization and its institutional milieu. Information regarding this program was obtained from interviews with state police officials, from defense counsel who represented plaintiffs in interdiction cases, and from court records of Valkyrie interdictions. It is suggested that two aspects of its institutional environment, the environment of legal precedent in which the program is embedded and the network of state and federal agencies using similar interdiction strategies, influence the organization and activity of Operation Valkyrie. The article argues that current program activity reveals the way in which Operation Valkyrie is, in turn, affecting these two aspects of its institutional environment. "

"The criminal justice system encompasses the most severe instrument at the state's disposal in times of peace. For this and many other reasons, overuse of that system is a serious matter. It may present itself in different forms. Overuse of criminalization may mean that too much conduct is criminalized without necessity. Overuse of prosecution may present itself if too many violations of criminal offences are prosecuted, while in certain individual cases or specific categories of cases it would be more effective, fairer, more efficient or otherwise desirable to refrain from prosecution and/or to apply alternative means, such as negotiating justice or administrative fines. Finally, the criminal justice system can be overused through the application and execution of too many or too severe prison sentences. All these forms of overuse are discussed in this volume. It contains one introductory chapter, seven thematic chapters and sixteen chapters on individual countries around the world. Themes discussed in these chapters are, among others, the principle that criminal law is and must be regarded as a so-called ultima ratio or ultimum remedium, the relevant human rights framework, worldwide statistics, and legal and practical restraints as well as possibilities to solve overuse. Containing an extensive collection of expert knowledge, this volume intends to expose legal possibilities, good practices and the many challenges that lie ahead when attempting to prevent overuse in the criminal justice system."

"This book presents a summary of the key ideas that seek to explain criminal behaviour and the measures that have been developed to prevent crime. A broad overview of the criminal justice system is provided in order to explain the operations of the key criminal justice agencies and the processes that are involved in bringing offenders to justice. Readers are encouraged to develop the basic knowledge they have obtained in these areas by tackling a number of questions, making use of additional reading of key texts suggested in the book. Attention is devoted to key sources from which information regarding crime and the criminal justice system can be explained. Good practice regarding the presentation and assessment of written work is also provided, in particular in connection with referencing. Readers are also introduced to the wide variety of methods that can be used to carry out criminological research and are invited to engage in exercises that include the marking of sample essays and the design of a questionnaire."

The phenomenon of Miscarriage of Justice is when a suspected criminal experiences prosecution, punishment, and detention because a crime that was not committed is a legal and social problem that occurs in the criminal justice system, it is also a systemic problem that can damage the integrity and legitimacy of the criminal justice process. As part of the object criminology studies, this paper aims to see how the manifestation of the phenomenon Miscarriage of Justice in the criminal justice system uses descriptions of 2 different cases, namely YT and YM cases, and describes the factors causing Miscarriage of Justice in these 2 cases based on indicators from Bohm (2005), Naughton (2007), Colvin (2009), and Poyser and Milne (2011). It also analyzes using the Miscarriage of Justice discussion by Forst (2004) regarding error of due process and associates this phenomenon with a perspective of justice in the criminal justice system, namely the due process model. Through analysis with this approach, using Court Decision and supporting documents as secondary data, it was found that the phenomenon of Miscarriage of Justice in YT and YM cases has similarities in the factors causing Miscarriage of Justice in their cases and the most contributing factor comes from investigation misconduct by the Police, which ultimately affects the subsequent criminal justice process. And this phenomenon can be said as a form of the due process model violation criminal justice system, which is due process procedural that also includes human rights violations in fair trial rights. In the study of the sociology of law, the manifestation of denial of the morality of legal practitioners in Durkheim’s thought, the irrationality of Weber’s modern law, and the false awareness of law in Peters’ thought."
