"Tesis ini membahas rencana Pemerintah untuk meratifikasi konvensi internasional Madrid Protocol yaitu suatu sistem pendaftaran merek secara internasional. Hasil penelitian hukum normatif yang bersifat eksplanatoris ini pun menyimpulkan bahwa Madrid Protocol memang memberikan manfaat bagi pemohon merek berupa biaya pendaftaran merek ke semua negara anggota konvensi yang jauh lebih murah serta, ketepatan jangka waktu pemrosesan pendaftaran. Namun, Pemerintah harus menunda rencana ratifikasi tersebut mengingat masih terdapat permasalahan lain yang menjadi fokus utama saat ini
The focus of this study is Government planning to ratify international convention Madrid Protocol that refers to trademark international registration system. This normative research which identified as explanatory found conclusion that Madrid Protocol itself contains benefit for the applicant of trademark registration such as low cost needed to do registration all over the state which are members of the convention also effectivity of time. But in other way, the Government have to cancelled the plan since there are still so many urgent problem need to handle first."

"Seiring dengan perkembangan dunia perdagangan global, merek semakin memiliki peran penting dalam suatu bisnis, bukan hanya sebagai tanda pembeda barang atau jasa sejenis yang diperdagangkan, tetapi juga sebagai strategi bisnis. Sehingga banyak pengusaha-pengusaha baik dari Indonesia maupun luar negeri yang ingin mereknya mendapatkan pelindungan di banyak negara. Sebelum tahun 1891, agar suatu merek mendapatkan pelindungan, pemohon harus mengajukan permohonan pendaftaran merek secara langsung ke negara-negara tempat pelindungan diinginkan. Kemudian pada tahun 1891 upaya untuk mempermudah proses pendaftaran merek secara internasional dimulai dengan lahirnya Madrid Agreement Concerning The International Registration of Marks (Persetujuan Madrid) dan diikuti dengan Protocol Relating to The Madrid Agreement Concerning The International Registration of Marks (Protokol Madrid) pada tahun 1989. Pada tanggal 2 Oktober 2017 lalu, Indonesia resmi menjadi anggota Protokol Madrid, dan telah berlaku efektif di Indonesia mulai tanggal 2 Januari 2018. Oleh karena itu dalam skripsi ini akah dibahas lebih lanjut mengenai ketentuan pendaftaran merek internasional dengan Sistem Madrid serta pengaruhnya terhadap pendaftaran merek di Indonesia.

Along with the significant growth of global trade, marks increasingly has an important role in a business, not only to differentiate similar traded goods or services but also as a business strategy. Thus, many local and foreign businesses seek for protection of marks in many countries. Prior to 1891, for a mark to be protected, applicants must file for a registration of marks directly to the countries where the protection sought. In 1891 attempts to facilitate the process of international registration of marks began with the signing of Madrid Agreement Concerning The International Registration of Marks and followed by Protocol Relating to The Madrid Agreement Concerning the International Registration of Marks (Protocol Madrid) in 1989. On 2 October 2017, Indonesia officially became a member of the Madrid Protocol and has come to effect in Indonesia since January 2, 2018. This thesis will further discuss about the international registration of marks using provisions in Madrid Protocol as well as its impact on the registration of marks in Indonesia."

"The end of the Cold war, marked by the collapse of the Soviet Union's communism has brought about the new political phenomenon. This phenomenon has given the impact not only to the dimension on international relations, but also, which even more important, to the evolution and progressive development of the world organization such as the United Nations. The application of a great deal of mandatory sanctions under Chapter VII as for instance, which was never practiced during the Cold War period, had given a lot of legal perplexities, particularly the three components of that Chapter, namely action with respect to threat to the peace, breaches of the peace, and the last is the primary important that are acts of agression. Moreover, on the consideration of the question of 'war of aggresion' constituting one of the International Criminal Court`s jurisdictions in the drafting of Statute of Rome, had been inconclussive, and no progress had been made. This article, therefore, may contribute to further development of the analysis of the core problem."
