"Tesis ini membahas mengenai pendaftaran tanah yang dilakukan secara sistematis dan pengaruhnya terhadap tertib pertanahan di wilayah kelurahan Serdang Jakarta Pusat dalam rangka memberikan kepastian hukum dan perlindungan hak milik atas tanah, sesuai dengan Peraturan Pemerintah No. 24 Tahun 1997 tentang Pendaftaran Tanah yaitu mengenai tata cara pelaksanaan pendaftaran tanah secara sistematik dan pengaruhnya terhadap tertib pertanahan serta apa sajakah hambatan yang terjadi di dalam pelaksanaannya, Penelitian ini menggunakan metode penelitian yuridis normatif dengan pendekatan kualitatif yang digunakan untuk memberikan gambaran secara kualitatif tentang pelaksanaan pendaftaran tanah. Berdasarkan hasil penelitian dapat disimpulkan bahwa pendaftaran tanah sistematik di Kelurahan Serdang Jakarta Pusat telah memberikan pengaruh yang signifikan dan positif dalam mewujudkan tertib pertanahan. Hal ini salah satunya dapat dilihat dari banyaknya bidang tanah yang telah berhasil di terbitkan sertifikat tanah sebagai alat bukti kepemilikan tanah dan hambatannya adalah kurangnya pengetahuan hukum pertanahan yang dimiliki oleh warga, rendahnya tingkat perekonomian yang berdampak terhadap kemampuan warga dalam pembayaran BPHTB (Bea Perolehan Hak Atas Tanah dan Bangunan) dan diperlukannya waktu panjang untuk memberikan pengarahan kepada warga.

This thesis discusses about the land registration done in a systematic and orderly land their influence in the sub-region Serdang Jakarta in order to provide legal certainty and the protection of property rights over land, according to Government Regulation No. 24, 1997 on Land Registration, namely the implementation of the procedure and the impact on orderly land and what are the obstacles that occur, this research uses research methods with normative juridical qualitative approach used to provide a qualitative picture about the implementation of land registration. Based on the results of research can be concluded that systematic land registration in Kelurahan Serdang Central of Jakarta has provided a significant and positive in order to realize land. This is one of them can be seen from many areas of land that has been successfully publish the certificate as evidence of land ownership and land constraints are the lack of legal land owned by residents, the low level of the economy that affect the ability of citizens in the payment BPHTB (Bea Acquisition Rights Land and Building) and requesting the length of time to provide guidance to citizens."

Masih banyaknya jumlah bidang tanah yang belum terdaftar dan terpetakan di Indonesia serta lambannya proses sertifikasi tanah menjadi latar belakang dibentuknya program Pendaftaran Tanah Sistematis Lengkap (PTSL). Para aktor pelaksana dituntut untuk melaksanan PTSL secara profesional yang mengacu pada ketentuan hukum maupun teknis sehingga tidak terjadi praktik maladministrasi. Hal tersebut menjadi alasan  dilakukannya penelitian yang bertujuan untuk menganalisis pelaksanaan program PTSL serta faktor-faktor yang mempengaruhi pelaksanaan program PTSL di Kantor Pertanahan Kota Jakarta Utara Tahun 2018. Penelitian ini menggunakan teori dari Edwards III (1980) dengan pendekatan post-positivist  dan teknik pengumpulan data kualitatif melalui wawancara mendalam dan studi pustaka. Hasil penelitian menunjukan bahwa dari segi capaian, pelaksanaan program PTSL tahun 2018 di Kantor Pertanahan Kota Jakarta Utara berhasil mencapai target yang telah ditetapkan. Namun, secara keseluruhan program PTSL di Kota Jakarta Utara belum dilaksanakan dengan baik dikarenakan terdapat beberapa kendala seperti kurangnya penyuluhan intensif dari Kantor Pertanahan, kurangnya kuantitas sumber daya manusia dan fasilitas dalam menunjang pelaksanaan PTSL, serta terdapat kekosongan hukum perihal peraturan teknis  pembiayaan persiapan pelaksanaan program PTSL. Peneliti juga menemukan faktor lain yang mempengaruhi dalam pelaksanaan program PTSL yaitu faktor kepemimpinan faktor sosial ekonomi masyarakat. 


The large number of land parcels that have not yet been registered and mapped in Indonesia and the slow process of land certification is the background for the establishment of a complete systematic land registration program (PTSL). The actors involved in this program are required to implement PTSL professionally which refers to legal and technical provisions so that there is no practice of maladministration, thus being the reasons for this research that aims to analyze the implementation of the PTSL program and the factors that influence it at the Land Office of North Jakarta in 2018. This research refers to the theory from Edwards III (1980) with a post-positivist approach with qualitative data collection techniques through in-depth interviews and literature studies. The results of the research show that in terms of achievement, the implementation of the PTSL program in 2018 at the Land Office of North Jakarta City successfully achieved the set target. However, overall the PTSL program in North Jakarta City has not been implemented properly due to several constraints such as lack of intensive counselling from the Land Office the quantity of human resources and facilities are still lacking in supporting the PTSL implementation, and there is a legal vacuum regarding technical regulations that regulate the financing of preparation for implementing PTSL programs. The researcher also found other factors that influence the implementation of the PTSL program, namely the leadership factors and the socio-economic factors of the community.

"Dalam kenyataannya ternyata hingga kini tanah-tanah di Indonesia, masih banyak dijumpai tanah yang belum terdaftar di Kantor Pertanahan, antara lain adalah tanah yang berstatus bekas Hak Milik Adat di Kelurahan Sunter Jaya, Kecamatan Tanjung Priok Kotamadya Jakarta Utara, dimana mereka tidak memiliki sertifikat. Mereka hanya mempunyai surat tanda pembayaran pajak atas tanah yang secara yuridis formal bukan merupakan alat bukti hak alas tanah, melainkan sebagai alat pelengkap untuk pendaftaran hak atas tanah.
Penelitian ini difokuskan kepada pokok¬pokok permasalahan mengenai faktor-faktor yang menjadi penyebab banyaknya tanah bekas Hak Milik Adat yang belum terdaftar di Kelurahan Sunter Jaya, Kecamatan Tanjung Priok Kotamadya Jakarta utara, dan upaya pemerintah melalui Kantor Pertanahan dalam memberikan kesadaran hukum bagi masyarakat untuk mendaftarkan tanahnya. Metode penelitian yang dipakai adalah penelitian kepustakaan dengan pendekatan normatif yang disertai dengan analisis data sekunder yang didukung dengan penelitian lapangan melalui studi dokumen dan wawancara.
Hasil penelitian dirumuskan sebagai kesimpulan bahwa faktor-faktor penyebab banyaknya tanah bekas Hak Milik Adat yang belum terdaftar adalah faktor kurangnya pengetahuan dari masyarakat mengenai mekanisme atau tata cara untuk mendaftarkan tanahnya, faktor ketidak pahaman masyarakat mengenai pentingnya pendaftaran atas tanah yang dimilikinya. Faktor ekonomi dan jangka waktu yang lama merupakan penyebah masih banyaknya tanah khususnya yang berstatus bekas Hak Milik Adat yang belum terdaftar di Kelurahan Sunter Jaya, Kecamatan Tanjung Priok Kotamadya Jakarta Utara. Pemerintah melalui Kantor Pertanahan, yang bekerjasama dengan Pemerintah Daerah setempat mulai dari tingkat Kecamatan dalam hal ini ada Kecamatan Tanjung Priok hingga ke tingkat Kelurahan, tclah membual program Kelompok Sadar Tertih Pertanahan (POKDARTIBNA) yang memberikan himbauan kepada masyarakat mengenai pentingnya mendaftarkan hak atas tanahnya dan penyuluhan tata cara pendaftaran tanah secara sporadik.

In Reality, it is apparent that presently lands in Indonesia are still often come across of not yet being registered at the land office, among others, land which are having the status of former Costumay Right of Ownership in Sunter Jaya Sub-district, Tanjung Priok District, North Jakarta Municipality, in which the owners do not have land certificates. They only have tax payment statementlrecept over the Iand, which in formal juridical manner, is not the evidence of right over land, instead, merely a supplementing instrument for the registration of right over land.
This research is focused on the main issues regarding factors which become the causes of large number of former costumay Right of Ownership lands which are not yet registered in Sunter Jaya Sub-district, Tanjung Priok District, North Jakarta Municipality, and the efforts of the government through Land Office in providing legal awareness service to the community to register their lands. The method of research being used is documentary research with normative approach supplemented by secondary data analysis supported by field research through documentary study and interview.
The result of research is composed as conclusion that the causing factors of large number of former Indigenous Right of Ownership Lands which are not yet registered are the factor of lack of knowledge of the community regarding the mechanism or procedure for registering their lands, the factor of unawareness of the community regarding the importance of registration of the land which they own. Economic factor and long period of process are the causes of large number of lands, especially having the status of former costumay Right of Ownership, which are not yet registered in Sunter Jaya Sub-district, Tanjung Priok District, North Jakarta Municipality. The Government through Land Office, in cooperation with the local Regional Government, starting from the level of District, in this case from Tanjung Prink District until Sub-District level, has prepared land order Awareness Group Program (POKDARTIBNA) that appeals to the community regarding the importance of registering their rights over lands and provides counseling regarding the procedure for sporadic land registration.

"Dalam penelitian ini menitikberatkan pada pelaksanaan pendaftaran tanah secara sistematik di Kelurahan Tanah Baru Kecamatan Beji Depok. Metode yang digunakan dalam penelitian ini adalah penelitian pendekatan yuridis normatif yaitu penelitian hukum yang dan bagaimana implementasinya dalam praktek. Pada kenyataannya pendaftaran tanah sistematik di Kelurahan Tanah Baru Kecamatan Beji Kotamadya Depok melalui proyek ajudikasi ini banyak mengalami kendala dari para pemegang hak atas tanah yang tidak bersedia tanahnya didaftarkan melalui ajudikasi. Pelaksanaan pendaftaran tanah sistematik ini dimulai dengan penyuluhan yang intensif tentang manfaat yang diperoleh bagi para pemegang hak atas tanah sehingga mereka tergerak untuk mendaftarkan tanahnya. Keberhasilan panitia ajudikasi dalam menerbitkan sertipikat hak atas tanah didukung juga peran serta dari Kepala Kelurahan Tanah Baru dan para Ketua RW dan RT setempat dalam memotivasikan warganya untuk mendaftarkan tanahnya secara sukarela dan menerima diadakannya proyek ajudikasi tersebut. Oleh karena itu keberhasilan proyek ajudikasi ini sebagai bukti kerjasama aparat setempat dengan segenap pelaksana operasional karena setiap kendala yang timbul dapat diselesaikan secara musyawarah dan mufakat."

Tanah Partikelir merupakan tanah yang diciptakan oleh Pemerintah Kolonial Belanda dengan cara menjual tanah tersebut kepada pihak swasta yang terdiri dari orang asing seperti golongan timur asing golongan eropa maupun golongan pribumi yang dianggap berjasa kepada VOC Tanah partikelir mempunyai hak hak keistimewaan yang bertentangan dengan prinsip keadilan sosial sehingga dianggap sebagai suatu negara didalam negara berbagai upaya penghapusan dilakukan baik oleh pemerintah kolonial Belanda sendiri maupun pemerintah Indonesia Upaya tersebut antara lain pembelian kembali tanah tanah partikelir kemudian pemerintah Indonesia melalui Undang Undang Nomor 1 Tahun 1958 Tentang Penghapusan Tanah Tanah Partikelir menegaskan bahwa tanah tanah partikelir maupun tanah tanah yang luasnya melebihi 10 bauw dihapuskan dan menjadi tanah negara dan kepada setiap pemilik tanah partikelir diberikan ganti kerugian berupa uang maupun hak atas tanah Salah satu tanah negara bekas tanah partikelir adalah di daerah Kelurahan Jembatan Lima Jakarta Barat yang sampai sekarang masih dimiliki oleh pemilik atau ahli warisnya maupun oleh pihak yang menguasai secara fisik tanah tersebut yang dibuktikan dengan surat partikelir atau eigendom verponding Namun sejak berlakunya undang undang tersebut alat bukti kepemilikan tanah partikelir masih diakui dan merupakan suatu dokumen administrasi yang diperlukan untuk pendaftaran sehingga secara de facto tanah partikelir masih diakui keberadaannya dan dapat didaftarkan untuk memperoleh hak atas tanah dan diberikan Sertipikat sebagai tanda bukti hak berdasarkan Peraturan Pemerintah Nomor 24 Tahun 1997 Tentang Pendaftaran Tanah.

"Untuk meningkatkan kualitas pelayanan pendaftaran tanah pada Kantor Pertanahan Jakarta Selatan, dirasakan penting untuk mengevaluasi kualitas pelayanan yang telah diberikan selama ini. Kualitas pelayanan dalam penelitian ini diukur dengan menggunakan dimensi model Servqual. Dimensi kualitas yang digunakan terdiri adalah dimensi tangible, reliability, responsiveness, assurance dan emphaty yang meliputi 21 indikator pelayanan. Dalam penelitian ini, metode importance performance analysis (IPA) digunakan untuk mengetahui indikator pelayanan mana yang perlu ditingkatkan.
Data dikumpulkan melalui kuesioner dengan menggunakan metode purposive sampling. Berdasarkan hasil penelitian, dapat disimpulkan bahwa kualitas pelayanan belum memenuhi harapan konsumen sehingga perlu meningkatkan layanan pada beberapa indikator terutama pemakaian sistem peralatan modern seperti sistem antrian, kecepatan waktu pengurusan sesuai standar prosedur, ketepatan jam buka layanan, pemberitahuan apabila berkas permohonan telah selesai, keberadaan bagian yang mendengarkan/membantu keluhan masyarakat, waktu tunggu untuk dilayani

To improve the quality of land registration services in South Jakarta Land Office, it?s necessary to evaluate the quality of services. The quality of service in this study is measured by the dimensions of Servqual model. Dimensions quality that is used consists of the dimensions of tangible, reliability, responsiveness, assurance and emphaty which included 21 service indicators. In this research, importance performance analysis (IPA) use to know which indicators of services need to improve.
Data collect with Quetioner and used purposive sampling. Based on the results of the study, it conclude that the service quality has not meet the consumer?s expectations so that needs to improve the services on some indicators especially the use of modern equipment such as queuing systems, speeds processing time according to the standard procedure, the accuracy of opening hours, notification when the application file has been completed, the existence division of complaints, the waiting time to be served."
