"In the development of electronic transaction, there is condition which puts consumer in a lower bargaining position, especially if the transaction held in an international trading. It will significantly reduce the consumer's bargaining position. The consumer's lower bargaining position is caused by the differences of jurisdiction that cause lack of legal certainty in a consumer disputes settlement. Law No. 11/2008 regulates about Information and Electronic Transaction does't discuss about international consumer disputes. Thus consumer needs legal protection such as state intervention in the field of transaction and business settlement. Consumer dispute settlement in an international electronic transaction must understand the rights of consumer so it can give legal choice and forum based on consumer law. There will be used by judges or arbiters as a consideration in order to settle consumer dispute. Therefore Online dispute Resolution (ODR) has been developed in order to vanish legal barriers in a process of settlement."

"Tesis ini membahas mengenai perlindungan hukum tentang penyelenggaraan sistem pembayaran elektronik menggunakan kartu. Perlindungan yang diatur pada undang-undang nomor 11 tahun 2008 tentang Informasi dan Transaksi Elektronik mengamanatkan pelaksanaan transaksi elektronik yang andal, aman dan bertanggung jawab. Pada prakteknya pelaksanaan ini belum terlaksana dengan baik. Tesis ini mencoba membahas peraturan-peraturan yang terkait dengan aspek perlindungan pengguna sistem pembayaran elektronik dengan alat pembayaran menggunakan kartu.

This thesis describes about the legal protection implemented on the enforcement of electronic payment system using payment card. The legal protection that are regulated in the law of Information and Electronic Transaction number 11 year 2008 is mandating for an electronic transaction practice that are secure, reliable and responsible. On the field this practice of regulation has not been well applied. This thesis will try to look other regulation that are related with the aspect of user protection on electronic payment system used with payment card."

"Tesis ini membahas mengenai urgensi kewajiban untuk melekatkan sidik jari penghadap pada minuta akta notaris berdasarkan Undang-undang Nomor 2 Tahun 2014 tentang Jabatan Notaris guna lebih menjamin kepastian identitas. Saat ini belum terdapat pengaturan lebih lanjut mengenai teknis pelaksanaannya, sehingga penelitian ini menguraikan formalitas perlekatan sidik jari yang benar, baik yang diambil secara manual (basah) maupun elektronik, berdasarkan Undang-undang Nomor 2 Tahun 2014 tentang Jabatan Notaris, Undang-undang Nomor 11 Tahun 2008 tentang Informasi dan Elektronik, serta ilmu daktiloskopi. Sebagai konsekuensinya notaris juga bertambah lagi amanatnya untuk melindungi sidik jari yang diambilnya yang merupakan data pribadi penghadap.

This thesis discusses the urgency of notary's obligation based on Law Number 2 Year 2014 to attach fingerprint(s) of person who appears before the notary to the notarial deeds and acts in order to ensure his or her identity and legal capacity. Currently there has been no further regulation regarding its implementation. This thesis explains how to attach manual and electronic fingerprints according to Law Number 2 Year 2014, Law Number 11 Year 2008, and dactyloscopy. Consequently, notary will also bear the obligation to protect the fingerprints as the personal data.

"Melalui pemanfaatan kemajuan teknologi, bank berusaha untuk memberikan fasilitas terbaik dalam melayani nasabah, salah satunya dengan ATM. Penggunaan ATM ini berkaitan dengan kemudahan dalam bertransaksi keuangan. Kemudahan dari layanan ATM membuat nasabah tidak perlu pergi ke bank dalam penarikan uang ataupun melakukan suatu transaksi transfer pemindahan uang yang ada pada rekening tabungan. Dalam penggunaan ATM risiko juga sering dihadapi oleh nasabah ataupun bank salah satunya risiko teknologi yang berhubungan dengan kehandalan dari keamanan sistem, salah satunya berkaitan dengan kegagalan sistem ATM.
Dalam penelitian ini, penulis menggunakan metode penelitian yuridis normatif dikarenakan bahan penelitian yang digunakan penulis adalah bahan-bahan hukum. Pertanggungjawaban bank jika terjadi kegagalan transaksi yang merugikan nasabah dengan menangani pengaduan nasabah, mengupayakan penyelesaian atas kerugian yang diderita nasabah melalui forum mediasi perbankan dan bertanggung jawab kepada konsumen atas kerugian yang timbul akibat kesalahan pengurus dan pegawai penyelenggara.

Through the utilization of advances in technology, banks are trying to provide the best facilities in serving customers, one of them with ATM. ATM usage is related to the ease of financial transactions. Ease of ATM services to make customers do not need to go to the bank to withdraw money or make a transfer of money transfer transactions that exist on savings accounts. Risks in the use of ATM are also often faced by customers or bank one technological risks associated with the reliability of safety systems, one of which relates to the failure of the ATM system.
In this study, the authors used normative juridical research method because the material used in this study is the author of legal materials. Bank liability in case of failure of transactions detrimental to customers and handling customer complaints, seek settlement of losses by clients through banking mediation forum; and responsible to consumers for losses incurred due to errors administrators and employees of the organizers.

"Perkembangan teknologi komunikasi dan Informasi yang begitu pesat dan dengan segala fasilitas penunjangnya telah membawa manusia masuk kedalam era digital. Pemanfaatan Teknologi Informasi, media, dan komunikasi telah mengubah baik perilaku masyarakat maupun peradaban manusia secara global. Teknologi Informasi saat ini menjadi pedang bermata dua karena selain memberikan kontribusi bagi peningkatan kesejahteraan, kemajuan, dan peradaban manusia, sekaligus menjadi sarana efektif perbuatan melawan hukum. Di Indonesia pemanfaatan teknologi ini dipayungi oleh UU Nomor 11 Tahun 2008 sebagai dasar hukumnya. Dengan adanya pengaturan ini maka diharapkan penggunaan teknologi informasi dapat dimaksimalkan. Ironis, pengaturan ini yang kemudian digunakan untuk menjerat seorang konsumen yang hanya menjalankan haknya untuk menyampaikan keluhannya. Hal ini kemudian yang menimbulkan pertentangan, bagaimana mungkin hak seorang konsumen untuk menyampaikan kritik atau keluhan terhadap pelaku usaha disimpangi undang-undang lain dan dianggap sebagai pencemaran nama baik. Hal ini yang kemudian menimbulkan pertanyaan, sebenarnya bagaimanakah hubungan antara konsumen dan pelaku usaha selama ini? Apakah sudah sesuai dengan cita-cita Undang-Undang Perlindungan Konsumen yakni memperjuangkan konsumen dan menyeimbangkan posisi kedua belah pihak. Apakah penerapan pasal pencemaran nama baik tersebut tepat apabila dilihat dari kacamata hukum perlindungan konsumen? Hak-hak konsumen sebenarnya sudah jelas diatur dalam UUPK begitupula dengan kewajiban pelaku usaha, namun hal ini tampaknya kurang dipahami sehingga pelaku usaha lebih memilih melakukan penuntutan terhadap konsumennya daripada harus menanggapi keluhannya.

The rapid growth of communication and information technology and every supporting facility has brought people into the era of digital. The utilization of information technology, media and communication has altered the behavior of both human society and civilization globally. Information Technology is currently regarded as a two-edged sword inasmuch as aside from the contributions to increase prosperity, development, and civilization, it is also used as an effective media to conduct tort. In Indonesia, the usage of this technology is covered under Law No. 11 of 2008 as a legal basis. Alongside with the existence of this regulation, the use of information technology is in expectation to be maximized. Ironically, such regulation is thereafter used to ensnare consumers who are only carrying out their rights to complain. This matter then resulted in the occurrence of conflict as to how can a consumer's right to convey criticism or complaints against entrepreneurs be over-ruled by other regulations and thus considered as a libel (or defamation). This issue leads to the question of how exactly is the relationship between consumers and entrepreneurs hitherto? Has it been in accordance with the ideals of the Consumers? Protection Act, which is to fight for consumers? rights and to balance the position of both parties? Is the implementation of the article on defamation valid when observed from the perspective of consumers? protection laws? Consumer rights has been clearly stipulated in the Consumer?s Protection Act as well as the obligations of entrepreneurs, but this seems to be less understood by the entrepreneurs to the point that they prefer to conduct prosecution against their customers instead of having to respond to their complaints."

"Baru-baru ini muncul istilah cyber law. Cyber hukum muncul dalam merespon perkembangan pesat yang dinamis, khususnya di bidang teknologi informasi. Pada 21 April 2008, pemerintah Indonesia melalui Dewan Perwakilan Rakyat Republik Indonesia (DPR-RI) telah menetapkan undang-undang tentang internet dan perdagangan elektronik (Undang-undang nomor 11 tahun 2008 tentang internet dan transaksi elektronik). Perkembang teknologi informasi membawan cara transaksi yang sangat berbeda dari yang konvensional (tatap muka transaksi). Dalam era baru, transaksi dalam perdagangan terjadi melalui situs Web yang ditawarkan oleh beberapa penyedia layanan internet dan dikenal sebagai perdagangan elektronik atau e-commerce. Jenis transaksi ini tentu saja sedikit berisiko bagi konsumen. Dan hukum di internet dan perdagangan elektronik akan melindungi mereka."

"The rapid development of information technology has been totally changed a conventional trading system. With convention trading system is meant that papers and signature are important substances and uses as authentic proven of a trading transaction, whilst in the case of electronic commerce is meant that documents and massages sent by electronic mail or website are used as legal basis as authentic proven of a trading transaction. Therefore, electronic information in the e-com became an important substance of legal ground of trading transaction. The Information and Electronic Transaction Law No. 11 year 2008 declares that electronic information and/or electronic document and/or the print-out of electronic information have become a valid avident for legal proven. The question is how to know technically that the documents of electronic information are proven as authentic document in the legal point of view. There are at least five eminent requisites for proving electronic document such as, authenticity, integrity, reliability, secrecy, and genuiness/originality of the electronic information."

"Saat ini teknologi digital membuat manusia dapat melakukan aktivitas berbelanja secara online menggunakan internet melalui e-commerce. Pembelian produk FMCG secara online melalui situs e-commerce saat ini berkembang pesat dan akan terus mengalami peningkatan untuk tahun-tahun berikutnya. Dalam penggunaan suatu website, user experience menjadi lebih penting dibandingkan dengan produk atau layanan lainnya. Tetapi, dari penelitian sebelumnya diketahui bahwa masih terdapat masalah usability pada official store produk FMCG di situs e-commerce.
Penelitian ini bertujuan untuk mengevaluasi user interface official store produk FMCG di situs e-commerce dengan menggunakan pendekatan user experience yaitu menggunakan performance metrics, self-reported metrics, behavioral metrics, dan issue-based metrics yang menilai kinerja, persepsi, perilaku, dan mengeluarkan apa yang dirasakan pengguna dalam berinteraksi dengan situs serta mengklasifikasi atribut desain yang sesuai prefrensi pengguna menggunakan model Kano.
Berdasarkan hasil evaluasi, diperoleh dalam dimensi ease of use, interface quality, dan satisfaction penilaian yang belum baik sehingga perlu dilakukan perancangan rekomendasi strategi dan desain interface yang dapat meningkatkan usability dan kepuasan pengguna.

Currently digital technology makes people can do shopping online using the internet via e commerce. Sales of FMCG products through e commerce websites are currently growing rapidly and will continue to improve for the following years. In the use of a website, user experience becomes more important than any other products or services. However, from previous research it is known that there is still usability problem when user using official store for FMCG product at e commerce website.
This study aims to evaluate the official store rsquo s user interface using the user experience approach with performance metrics, self reported metrics, behavioral metrics, and issue based metrics that assess performance, perception, behavior, and issue that the user perceives when interacting with the website and classifies the design attributes that suit the user 39 s preference using the Kano model.
Based on the evaluation results, in the dimensions of ease of use, interface quality, and satisfaction was not good enough, so that strategy and interface design recommendation is done.

"Every end-user of goods and/or services available at community, for individual benefit, family, other person and another human kinds has the right to legal protection. Cellular-phones user have the right to legal protection from any illegal action conducted by cellular operator. A decision giving beneficial impact to the consumer of cellular-phone is KPPU's decision No. 07/KPPU-L/2007. The benefit is reduction on cellular-phone tariff according to government in this case Department of Communication and Information dated 4 February 2008 concerning policy on tariff of phone service including cellular-phone. A new thing which shall receive appreciation from the KPPU's decision is to place consumer interest as priority in its evaluation over violation of article 27 of Act No. 5 year 1999 concerning Antimonopoly and Unfair Competition."
