"Ketentuan mengenai kejahatan genosida yang terdapat dalam Statuta Roma dari Pengadilan Pidana Internasional dan Elements of Crimes mensyaratkan elemen baru yang disebut sebagai elemen kontekstual. Ketentuan mengenai elemen kontekstual dari kejahatan genosida mensyaratkan tindakan yang dilakukan atas pola tindakan yang sama atau dapat sendirinya menyebabkan kemusnahan kelompok yang menjadi sasaran. Keberadaan elemen kontekstual ini mengubah ruang lingkup dari kejahatan genosida yang sudah bertahan selama 50 tahun. Skripsi ini menganalisis perkembangan elemen kontekstual dari kejahatan genosida beserta dampak-dampak yang ditimbulkan terhadap ruang lingkup kejahatan genosida yang ada dalam ketentuan Statuta Roma dari Pengadilan Pidana Internasional.
