"Skripsi ini memuat pembahasan mengenai peraturan terkait tanggung jawab hukum pelayanan kesehatan primer dalam memberikan pelayanan gawat darurat. Bentuk penelitian skripsi ini adalah yuridis normatif dengan metode analisis data kualitatif. Penelitian ini dikaitkan dengan pengaturan mengenai pelayanan gawat darurat dan pelayanan kesehatan primer yang terdapat dalam Undang-Undang Nomor 36 Tahun 2009 tentang Kesehatan, Peraturan Menteri Kesehatan No. 47 Tahun 2018 tentang Pelayanan Kegawatdaruratan, dan Peraturan Menteri Kesehatan No. 19 Tahun 2016 tentang Sistem Penanggulangan Gawat Darurat Terpadu. Dalam penelitian ini, ditemukan bahwa pelayanan gawat darurat menjadi suatu kewajiban yang tidak boleh ditolak oleh pelayanan kesehatan primer di Indonesia sebagai bentuk perlindungan hak atas pemeliharaan kesehatan. Kepala Dinas Kesehatan Kabupaten/Kota dan Bupati/Wali Kota bertanggung jawab atas kelalaian atau penyimpangan dalam pelayanan kegawatdaruratan yang menyebabkan kerugian pada pasien sebagai bentuk penerapan vicarious liability dan doktrin “respondent superior”. Hasil penelitian ini menyarankan agar pemerintah daerah dan instansi-instansi terkait melakukan pengawasan dan pembinaan terhadap pelayanan kesehatan primer secara rutin untuk mencegah penyimpangan dalam pelaksanaan pelayanan kegawatdaruratan.

This thesis discusses regulations related to the legal liability of primary health care in providing emergency care. The form of this thesis research is normative juridical with qualitative data analysis methods. This thesis is based on laws and regulations regarding emergency care and primary health care found in Law No. 36 of 2009 about Health, Ministerial Regulation of the Health Ministry No. 47 of 2018 about Emergency Care and Ministerial Regulation of the Health Ministry No. 19 of 2016 on Integrated Emergency Response System. The study shows that emergency services are an obligation that cannot be denied by primary health care in Indonesia as a form of protection of the right to health care. Heads of District/City Health Offices and Regents/Mayors are responsible for the negligence or irregularities in emergency care that cause harm to patients as the implementation of vicarious liability and the "respondent superior" doctrine. This study suggests that local governments and related agencies carry out supervision and guidance on primary health care on a regular basis to prevent irregularities in the implementation of emergency services."

"Belakangan ini muncul aplikasi yang dapat memenuhi kebutuhan pasien. Aplikasi tersebut berfungsi menghubungkan pencari layanan kesehatan dengan tenaga kesehatan. Salah satu pelayanan yang dapat diakses melalui aplikasi tersebut adalah home care dan doctor visit, yang memungkinkan dokter dan/atau tenaga kesehatan lain dapat melaksanakan praktik kesehatan di rumah pasien. Tetapi, kenyataannya belum ada peraturan perundang-undangan yang mengatur terkait dengan praktik kedokteran secara home care. Hal ini menyebabkan belum adanya kepastian hukum mengenai legalitas praktik kedokteran secara home care, wewenang dan tanggung jawab hukum dokter saat menjalankan praktik kedokteran secara home care, mengatur terkait dengan Surat Izin Praktik Dokter yang menjalankan praktik kedokteran secara home care. Metode Penelitian dalam penelitian ini adalah yuridis normatif. Kesimpulan dalam skripsi ini pengaturan pelayanan kesehatan home care di Indonesia secara umum dapat mengacu pada Undang-Undang No. 29 Tahun 2004 tentang Praktik Kedokteran, yang pelaksanaannya di rumah pasien, secara khusus dapat berlandaskan pada Peraturan Daerah masing-masing daerah dan wewenang dan pertanggungjawaban hukum dokter dan penyedia aplikasi terhadap pelayanan kesehatan home care dapat dilihat dari hubungannya kerja antara keduanya. Saran untuk penelitian ini Kementerian Kesehatan sebaiknya membentuk peraturan yang secara khusus mengatur mengenai home care.

There are many applications that can meet patient needs. The application serves to connect health care seekers with health workers. One of the services that can be accessed through the application is home care and doctor visits, which allows the doctor and/or other health workers to practice health in the patients home. However, in reality there is no legislation regulating related to home care medical practice. It causes the absence of legal certainty regarding the legality of medical practice in home care, the authority and legal responsibility of doctors when carrying out home care medical practices, regulating related to the Doctors Practice Permit that runs home care medical practice. My research method in this thesis is normative juridical. Conclusion of this thesis is regulation of home care in general can refer to Law No. 29 Year 2004 concerning Medical Practice which is carried out in patients homes, can be based specifically on the Regional Regulations of each region. The authority and legal responsibility of doctors and application providers for home care health services can seen from the working relationship between doctors and application providers. Suggestions for this research is Ministry of Health should make regulation that specifically reglulate home care."
