"Sektor industri atau disebut pengolahan non migas merupakan kontributor terbesar pendapatan ekonomi dan penyerapan tenaga kerja di Indonesia. Jumlah penduduk Indonesia yang lebih dari 250 juta mengindikasikan besarnya potensi pasar domestik sekaligus jaminan sektor industri Indonesia terus bertumbuh. Namun demikian, komitmen liberalisasi perdagangan antar negara yang semakin tinggi sejak berdirinya World Trade Organization (WTO), memaksa sektor industri Indonesia bersaing dengan Industri negara-negara berteknologi maju.
Dalam persaingan itu, industri Indonesia terus mengalami pelemahan daya saing baik di pasar domestik maupun ekspor. Hal ini sangat terlihat nyata terjadi pada Industri Tekstil dan Produk Tekstil (ITPT). Menghadapi situasi yang dinilai banyak pihak sebagai de-industrialisasi tersebut, Pemerintah Indonesia mengambil langkah strategis menggunakan bantuan finansial (financial contribution) sebagai salah satu instrumen kebijakan peningkatan daya saing industri. Pada praktiknya, komitmen Indonesia sebagai anggota WTO tidak bisa dikesampingkan. Beberapa perjanjian yang dicakup (covered agreement) dalam pembentukan WTO, seperti General Agreement on Tariffs and Trade 1994 (GATT) dan Agreement on Subsidies and Countervailing Measures mengatur batasan bantuan finansial yang dapat atau dilarang untuk diberikan pemerintah. Perspektif pengaturan subsidi dalam WTO adalah pemberian subsidi lazim dilakukan pemerintah suatu negara untuk peningkatan kemakmuran dan perlindungan kepentingan domestik, namun juga berpotensi mendistorsi perdagangan internasional apabila menimbulkan keuntungan kompetitif bagi sektor swasta secara tidak adil.
Dengan menggunakan perspektif itu, dilakukan studi hukum pelaksanaan program restrukturisasi mesin/peralatan ITPT yang memuat kebijakan pembiayaan pemerintah untuk peningkatan daya saing ITPT. Diharapkan ditemukan pemahaman kritis akan desain kebijakan penggunaan instrumen subsidi oleh pemerintah dengan tetap mengindahkan komitmen Indonesia dalam WTO. Momentum penulisan tesis diperkuat dengan Pasal 45 dan Pasal 47 Undang-Undang Nomor 3 Tahun 2014 tentang Perindustrian yang mengatur bahwa pemerintah dapat memberikan pembiayaan kepada perusahaan industri swasta dalam rangka peningkatan daya saing industri dalam negeri atau pembangunan industri pionir. Bentuk pembiayaan dimaksud dapat berupa keringanan bunga pinjaman, potongan harga pembelian mesin dan peralatan, serta bantuan mesin dan peralatan.

The industry sector, or called with non oil and gas manufacturing sector, is the largest contributor to economic income and employment in Indonesia. Indonesia's population of over 250 million indicates the potential of the domestic market as well as the guarantee of Indonesia's industrial sector continues to grow. Nevertheless, the increasing commitment of trade liberalization between countries since the establishment of the World Trade Organization (WTO) has forced the Indonesian industrial sector to compete with industries from countries with advanced technology.
In that competition, Indonesia's industrial competitiveness continues to weaken both in domestic and export markets. Significant impacts occurred in the Textile and Textile Products Industry (ITPT). Faced with the situation that many considered as de-industrialization, the Government of Indonesia took a strategic step to use financial assistance as one of the policy instruments to increase the competitiveness of industry. In practice, Indonesia's commitment to WTO membership can not be ruled out. Some covered agreements in the establishment of the WTO, such as the General Agreement on Tariffs and Trade 1994 (GATT) and Agreement on Subsidies and Countervailing Measures provide provisions for financial assistance that can be granted or prohibited by the government. The perspective of the subsidy provisions in the WTO is that subsidies are commonly applied by a country's government to increase prosperity and protection of domestic interests, but also potentially distort international trade if it causes unfairly competitive advantage for the private sector.
By using that perspective, the authors conducted a legal study on the implementation of the ITPT machine / equipment restructuring program which contains a government financing policy to improve the competitiveness of ITPT. It is expected to find a critical understanding of the policy design of the use of subsidized instruments by the government by taking into account Indonesia's commitment to the WTO. The momentum of thesis writing is reinforced by Article 45 and Article 47 of Law No. 3 of 2014 on Industrial Matters which contains provisions that the government can provide financing to private industrial companies in order to increase the competitiveness of domestic industry or the development of pioneer industries. The financing stated in Article 47 covers three forms of financing, which include: loan interest rate, discounted purchase of machinery and equipment, and machinery and equipment assistance.

"ABSTRAK
Penelitian ini membahas mengenai penerapan ketentuan peraturan perundang-undangan Indonesia terhadap perdagangan komoditas kopi ditinjadu dari ketentuan WTO. Selain itu, penelitian ini juga membahas mengenai dampak dari pelaksanaan ketentuan WTO terhadap pasar dan industri kopi nasional. Penelitian ini menggunakan metode penelitian yuridis normatif dengan studi kepustakaan terhadap bahan-bahan hukum seperti buku dan perundang-undangan, serta studi kasus , dimana suatu kesimpulan dapat ditarik yaitu ketentuan peraturan perundang-undangan Indonesia terhadap perdagangan komoditas kopi pada dasarnya sudah sesuai dengan ketentuan WTO, hanya saja dampak dan akibatnya menimbulkan efek yang beragam terhadap perkembangan industri komoditas kopi nasional dan perdagangan kopi indonesia di pasar internasional

ABSTRACT
This study discusses the application of the provisions of Indonesian legislation to trade in coffee commodities are imported from the WTO provisions. In addition, this study also discusses the impact of implementation of WTO provisions on national coffee market and industry. This study uses normative juridical research method with literature study on legal materials such as books and legislation, and case studies, where a conclusion can be drawn that the provisions of Indonesian legislation on coffee commodity trading is basically in accordance with the provisions of the WTO, it 39 s just that the impact and consequences have a diverse effect on the development of national coffee commodity industry and Indonesian coffee trade in the international market."

"Pertumbuhan sektor industri tekstil memunculkan fenomena pencemaran limbah tekstil yang dikualifikasi sebagai limbah bahan berbahaya dan beracun limbah B3. Kondisi nyata pencemaran limbah tekstil terjadi di Jawa Barat, khususnya DAS Citarum beserta anak sungainya. Hingga saat ini masih banyak perusahaan tekstil yang belum melaksanakan kewajiban pengelolaan limbah B3. Penelitian ini dilakukan dengan metode penelitian hukum yuridis normatif. Permasalahan yang diteliti antara lain mengenai pengaturan tanggung jawab perusahaan tekstil dalam pengelolaan limbah B3 menurut peraturan perundang-undangan di Indonesia, sistem pengelolaan limbah B3 di PT. Kahatex II dalam mencegah pencemaran dan/atau kerusakan lingkungan hidup, serta kebutuhan pengaturan ke depan terkait pengelolaan limbah B3 cair yang dibuang ke sumber air.
Penelitian ini menyimpulkan bahwa suatu perusahaan tektil bertanggung jawab untuk melaksanakan kewajiban dan tidak melakukan larangan yang diatur dalam izin pengelolaan limbah B3 maupun peraturan perundang-undangan terkait pengelolaan limbah B3. Selanjutnya PT. Kahatex II sebagai penanggungjawab usaha dan/kegiatan telah memenuhi tanggung jawab pengelolaan limbah B3 yang dibebankan terhadapnya. Kemudian terdapat kebutuhan pengaturan ke depan terkait pengelolaan limbah B3 cair perusahaan tekstil seperti pengaturan lebih lanjut mengenai kewajiban pengurangan limbah B3 dan sanksinya, standar kepekatan warna atau kekeruhan air limbah, penetapan baku mutu air sungai serta daya tampung beban pencemaran sumber air.

The growth of companies in textile industry raises the phenomenon of environmental pollution by textile waste pollution that is qualified as waste of hazardous and toxic materials waste of B3. The actual condition of environmental pollution by textile waste happened in Citarum River Basin and Citarum tributaries. Until now some of textile companies still throw out textile waste to the river without processing on installation of waste water treatment. The research method of this thesis is normative and juridical research. This thesis will examining the regulation in Indonesia about liability of textile industry in waste management of hazardous and toxic materials, the waste management system in PT. Kahatex II and future regulation that related to waste management of liquid hazardous and toxic materials.
This research concludes that a textile company has some responsibility to fulfill its obligations on secure license from the authority and any regulation that related to waste management of hazardous and toxic materials. Furthermore, PT. Kahatex II has fulfilled the responsibilities on waste management of hazardous and toxic materials. Through this research, Indonesia need develop the regulations for the waste management of liquid waste from textile company such as regulation about penalty for disobeying the obligation to reduction waste of B3, color standard of water waste from textile company, quality standard of water and carrying capability of the river."

"Pengelolaan minyak dan gas bumi di Indonesia telah diatur dalam pasal 33 ayat (3) Undang-Undang Dasar 1945. Dalam pengaturan tersebut terdapat konsepsi penting terkait pengelolaan minyak dan gas bumi yaitu konsep ?hak menguasai negara?. Pada perjalanan sejarah peraturan perundang-undangan yang mengatur pengelolaan minyak dan gas bumi sejak awal Indonesia merdeka dan hingga kini, konsepsi ini masih selalu menjadi perdebatan. Hingga akhirnya terjadi judicial review yang diajukan ke Mahkamah Konstitusi terhadap UU No. 22 tahun 2001. Putusan Mahakamah Konstitusi yang tertuang pada putusan Nomor 36/PUU-X/2012 memiliki ekses besar dengan dibubarkannya BP Migas sebagai badan pelaksana pengelolaan sektor hulu migas Indonesia. Oleh karena itu akhirnya melalui Peraturan Presiden No. 9 tahun 2013 dibentuklah SKK Migas untuk menggantikan peran dari BP Migas. Dalam Perpres No. 9 tahun 2013 ini kemudian akan terlihat implementasi pasal 33 ayat (3) UUD 1945 pada tugas dan kewenangan SKK Migas sebagai pelaksana pengelolaan sektor hulu migas di Indonesia terutama terkait konsepsi hak pengusaan oleh negara.

Management of oil and gas in Indonesia is regulated in Article 33 paragraph (3) of the Constitution of 1945. In these regulation, there is an important concept related to the management of oil and gas specifically the concept of "right of control by the state". In the history of legislation governing the management of oil and gas since the beginning of Indonesia's independence, and until now, this concept is still always a debate. Until finally happened judicial review filed with the Constitutional Court against the Law No. 22/2001 contained in the Constitutional Court decision No. 36/PUU-X/2012 have large excesses with the dissolution of BP Migas as the executing agency management of upstream oil and gas sector in Indonesia. Therefore finally through Presidential Regulation. No. 9/2013, SKK MiGas was formed to replace the role of BP Migas. In Perpres. 9/2013 will then be visible implementation of Article 33 paragraph (3) of the 1945 Constitution on the duties and authority of the executive management of oil and gas SKK upstream oil and gas sector in Indonesia is mainly related to ?right of control by the state."

Skripsi ini menjelaskan penelitian mengenai cara penyelesaian sengketa dalam perdagangan internasional dibawah organisasi perdagangan dunia dengan mengangkat kasus rokok kretek yang terjadi pada tahun 2010 antara Indonesia dan Amerika Serikat. Penelitian skripsi ini menggunakan pendekatan normatif untuk mengelaborasi dan menganalisis dalam hal langkah-langkah dalam proses penyelesaian sengekta rokok kretek yang melalui serangkaian tahap beracara yang sudah diatur didalam Dispute Settlement Understanding WTO. Hasil analisis membawa pada penyelesaian akhir yaitu dengan dikeluarkannya Memorandum of Understanding yang telah disepakati oleh kedua Negara.

International trade is one system of cooperation between countries in economic aspects. Various efforts have been made by the government to create the efficient of international trade and can be beneficial for any State incorporated in such activities. One of which is to create an international forum as the only official institution that can handles in world trade activity aspects. This research elaborate on how to resolve disputes in international trade under the world trade organization by took clove cigarette case that occurred in 2010 between Indonesia and the United States as the example. This research uses normative approach to elaborate and analyze in terms of steps in the process of clove cigarette resolution through a series of stages that have been arranged in Dispute Settlement Understanding WTO. The results of the analysis lead to the final resolution, the issuance of a Memorandum of Understanding agreed upon by both parties countries."

jadi di Indonesia yang sangat pesat memengaruhi impor dan ekspor nasional.
Kemudian, terjadi lonjakan impor dalam sektor industri tekstil – kain dan pakaian
jadi menyebabkan adanya kerugian serius dan/atau ancaman kerugian serius.
Sehubungan dengan hal tersebut, penelitian ini menganalisis pengaturan tindakan
pengamanan (safeguards) sesuai dengan ketentuan WTO. Selain itu, penelitian ini
juga menganalisis penyelidikan dalam pemberitahuan G/SG/N/8/IDN/23-
G/SG/N/10/IDN/23 dan G/SG/N/6/IDN/36 mengenai tindakan pengamanan yang
akan diambil oleh Pemerintah Indonesia. Selanjutnya, analisis ini menggunakan
metode yuridis tindak dengan menganalisis data sekunder. Indonesia sebagai salah
anggota negara dalam WTO telah menandatangani Perjanjian WTO yang di
dalamnya termasuk mengenai Perjanjian Tindakan Pengamanan (Safeguards).
Ketentuan Tindakan Pengamanan sesuai dengan Perjanjian Pengamanan
menyebutkann adanya beberapa syarat untuk pengenaan Tindakan Pengamanan
yang tertera pada Pasal 4.2(b) Perjanjian Pengamanan. Indonesia telah
mengundangkan Keputusan Presiden No. 84 Tahun 2002 tentang Tindakan
Pengamanan Industri dalam Negeri dari Akibat Kebijakan Impor.Tindakan
pengamanan didefinisikan sebagai tindakan “darurat” sehubungan dengan
peningkatan impor produk tertentu. Dalam kedua pemberitahuan tersebut dapat
dipahami bahwa tindakan pengamanan sementara yang diambil adalah untuk
mengatasi kerugian serius yang dideritas industri dalam negeri.

A significant growth in the textile-fabric and apparel industry sector in Indonesia
rapidly affecting national imports and exports. Thus, when there was a surge in
imports in the textile industry sector - fabrics and apparel, which causing serious
losses and / or the threat of serious losses. Hence, this study analyzes safeguards in
accordance with WTO provisions. In addition, this study also analyzes the
investigations in the notification of G / SG / N / 8 / IDN / 23-G / SG / N / 10 / IDN
/ 23 and G / SG / N / 6 / IDN / 36 regarding the security measures that will be taken
by the Government of Indonesia. Furthermore, this analysis uses the follow-up
juridical method by analyzing secondary data. Indonesia as a member of the WTO
has signed a WTO Agreement which includes the Safeguards Agreement.
Safeguard provisions in accordance with the Safeguard Agreement states that there
are several conditions for the imposition of Safeguard Measures as stated in Article
4.2 (b) of the Security Agreement. Indonesia has promulgated Presidential Decree
No. 84 of 2002 concerning Domestic Industry Safeguards from the Impact of
Import Policies. Safeguards are defined as an "emergency" measures in connection
with the increase in imports of certain products. In both notifications it is
understood that the temporary safeguards are being taken to overcome serious
losses suffered by the domestic industry.
