"Pada praktiknya, Polri terkadang membutuhkan bantuan TNI dalam melakukan pemeliharaan keamanan dan ketertiban masyarakat. Namun, belum ada pengaturan yang secara komprehensif mengatur mengenai perbantuan TNI kepada Polri. Menanggapi hal ini, Polri dan TNI menyepakati nota kesepahaman, perjanjian kerjasama, dan pedoman bersama untuk mengatur mengenai perbantuan TNI kepada Polri dalam memelihara Kamtibmas. Dengan metode penelitian yuridis-normatif, tulisan ini menelaah keberlakuan nota kesepahaman, perjanjian kerjasama, dan pedoman bersama antara Polri dengan TNI berdasarkan peraturan perundang-undangan serta doktrin-doktrin hukum. Dalam hal ini, Nota Kesepahaman, Perjanjian Kerjasama, dan Pedoman Bersama antara Polri dengan TNI masih bertentangan dengan UU TNI yang mengatur bahwa pengerahan OMSP harus berlandaskan pada kebijakan dan keputusan politik negara. Salah satu cara untuk menyediakan landasan hukum OMSP dengan selaras dengan UU TNI adalah dengan mengaturnya dalam UU yang merupakan peraturan yang disepakati bersama oleh Pemerintah dengan DPR RI.

In practice, the National Police sometimes needs the help of the National Armed Force in order to maintain safety and public order. So far, there has been no law that comprehensively regulate military involvement in helping the police to maintain safety and public order. The National Police and National Armed Force then agreed on a memorandum of understanding, agreement, and joined guidelines to regulate military involvement in helping the police to maintain security and public order. With normative legal research, this paper discusses the binding power of memorandum of understanding, agreement, and joined guidelines used by The National Police and National Armed Force. In this case, the memorandum of understanding, agreement, and joined guidelines between Indonesian National Police and Indonesian National Armed Force contradict Law Number 34 of 2004 because it does not stated that a national state policy is a prerequisite for involving the military in protecting safety and public order. One way to provide this national state policy is for the government along with the house of representative to create a new law to regulate military involvement in protecting safety and public order."
