"Peristiwa Uberlingen Mid-Air Collision tahun 2002 di wilayah Jerman antara Bashkirian Airlines dengan DHL menarik perhatian khalayak luas kepada dunia penerbangan internasional. Bashkirian kemudian membawa kasus ini ke Pengadilan Konstanz di Jerman dalam perkara perdata untuk meminta ganti kerugian kepada Jerman atas segala tuntutan dari pihak ketiga. Pengadilan kemudian memutuskan Jerman harus bertanggung jawab atas peristiwa tersebut dan harus menanggung biaya ganti kerugian akibat peristiwa tersebut. Diketahui bahwa kejadian tersebut berada di wilayah udara Jerman yang lalu-lintas penerbangannya dilakukan oleh Skyguide. Skripsi ini dimaksudkan untuk menjelaskan bentuk tanggung jawab negara atas keselamatan dan keamanan navigasi di wilayah udaranya yang apabila tidak dilakukan dapat menimbulkan tanggung jawab negara. Skripsi ini kemudian akan menganalisis terkait pengaturan dan kewajiban negara dalam memberikan fasilitas navigasi penerbangan yang aman menurut hukum internasional.

The Uberlingen Mid-Air Collision which happened in Germany in 2002 between Bashkirian Airlines and DHL had attracted the international community to international civil aviation activities. Bashkirian then brought this case before the Dictrict Court in Konstanz which sued Republic of Germany to indemnify the company for damage claims against the airine by third parties. The Court then decided Germany should responsible to Bashkirian and indemnify all the cost claimed against the airline. The collision occured at German?s territory which controlled by Skyguide. This thesis is aimed to elaborate the state liability on safety and security of air navigation in its territory which failure to do so will result a state responsibility. This thesis will analyze the provisions and the state?s liabilities in providing the safe air navigation facilities according to international law."

"ABSTRAK
Pelanggaran wilayah udara dan kontrol udara Indonesia oleh Singapuramerupakan
aspek penting dan strategis bagi pertahanan dan keamanan wilayah negara Indonesia.
Perhatian pemerintah Indonesia terhadap pentingnya ruang udara menunjukkan bahwa
kualitas kebijakan negara terhadap matra udara belum signifikan. Ruang udara Indonesia
yang dikontrol oleh Singapura merupakan merupakan hal penting bagi Indonesia untuk
ditinjau kembali dalam rangka menegakkan keutuhan negara.
Perjanjian antara Indonesia dan Singapura soal ruang udara dalam pelaksanaannya
telah banyak menimbulkan kendala baik dari penerbangan sipil Indonesia maupun
pelaksanaan operasi dan penegakan hukum di wilayah sekitar Tanjung Pinang dan Natuna
yang dilaksanakan baik oleh TNI AU maupun oleh TNI AL yang melaksanakan operasi
maritim maupun operasi udara, karena pengendalian ruang udara tersebut ada pada Air
Traffic Control (ATC) Singapura.
Sebagai pijakan teoritis penelitian ini menggunakan teori pembangunan politik
dari Samuel P. Huntington, teori orientasi pembuat kebijakan dari K.J. Holsti, dan teori
kebijakan publik menurut William Dunn. Metode penelitian yang digunakan adalah
metode kualitatif, sedangkan tipe penelitian adalah deskriptif analisis sedangkan metode
pengumpulan data dengan wawancara dan studi dokumen.
Temuan penelitian menunjukkan bahwa kebijakan yang diambil oleh pemerintah
Indonesia terkait Flight Information Region (FIR) tidak sesuai dengan kepentingan
pertahanan udara nasional Indonesia. TNI AU sebagai pelaksana tugas pokok pertahanan
nasional matra udara bukan menjadi pihak insider untuk turut menentukan lahirnya
kebijakan negara di bidang FIR. Pengambilan keputusan hanya berada dalam satu lembaga
negara dan tidak mengikutsertakan lembaga lain yang berkompeten dalam merumuskan
kebijakan strategis.
Implikasi teori menunjukkan bahwa terori Huntington yang mengatakan bahwa salah
satu unsur dari pembangunan politik (antara lain) membutuhkan penonjolan tegas
kedaulatan eksternal negara bangsa dalam menangkal pengaruh internasional. Tesis
Huntington tersebut mensyaratkan adanya ketegasan dengan menggunakan seluruh
otoritasnya dalam menjaga seluruh wilayah kedaulatannya. Sementara K.J. Holsti
mengatakan bahwa dalam proses pembuatan kebijakan luar negeri, pengambilan keputusan
didominasi oleh orientasi para pembuat kebijakan tingkat tinggi (high level policy makers).
Holsti memberikan penekanan yang lebih kuat tentang pentingnya melihat orientasi para
pembuat keputusan/kebijakan. Pendapat kedua ahli tersebut tidak terlihat digunakan dalam
pembuatan kebijakan di Indonesia. Selain itu tahapan kebijakan publik dari William Dunn
seperti : Penyusunan Agenda, Formulasi kebijakan, Adopsi Kebijakan, Implementasi
Kebijakan, Evaluasi Kebijakan tidak menjadi referensi bagi pengambil kebijakan negara
Indonesia.

ABSTRACT
The violation of the Indonesian air space and the control to Singapore is
the crucial aspect even strategic to Indonesian security and defense. The deficient
of Indonesian government attention to the air space is showing the quality of state
policy to airspace tends to less significant. The air space, which has been
controlling by Singapore, is becoming big issue to be reviewed in building the
Indonesian sovereignty.
The agreement of air space between Indonesia and Singapore has impacted
to Indonesian civil flights even for operation implementation and law enforcement
in Tanjung Pinang and Natuna authorities that conducted by both Indonesian
Navy and Air Force that have implemented maritime and air space operations as
the control base of air space using the Singapore Air Traffic Control (ATC).
The theoretical base of this research applies the politic development of
Samuel P. Huntington, policy maker orientation theory of K.J. Holsti, and the
theory of public policy by William Dunn. This research is implemented a
qualitative method and used descriptive analysis research type with interviewing
and documents study in gaining the data collection.
The findings from this research have shown that the policy of Indonesian
government dealing with Flight Information Region (FIR) did not meet with the
need of Indonesian national air force defense. The Indonesian Air force as the
agent of the main duty in defending the national air space is not the insider party
in determining state policies of FIR. The decision making was merely determined
in a state institution without involving related institutions that have competence in
designing strategic policy.
Theory implication is showing that Huntington theory revealed that one
element in politic development acquires a firm state and country external
sovereignty in preventing international effects. Huntington thesis requires
firmness in using whole authorities to defend all Indonesian sovereignty areas.
Meanwhile, K.J. Holsti said that in a process of designing overseas policy, the
decision taking dominated by an orientation of high level policy makers. Holsti
strongly emphasized to the importance of orientation observation of the decision
and policy makers. The opinion of the both experts seems unlikely implemented
in policy designing in Indonesia. In addition, the William Dunn of public policy
such as: Agenda arrangement, Policy formulation, Policy adoption, Policy
implementation, and Policy evaluation are not implemented as references in
policy taking in Indonesia."
