"Salah satu asas dalam Hukum Acara Perdata adalah asas hakim pasif. Asas ini mengatur bahwa hakim dilarang untuk memperluas ruang lingkup pokok perkara dan memberikan putusan terhadap apa yang tidak diminta oleh penggugat. Dalam praktek peradilan perdata di Indonesia, penerapan asas ini telah mengalami pergeseran berdasarkan beberapa putusan Mahkamah Agung. Skripsi ini akan membahas mengenai ketentuan asas hakim pasif dalam Hukum Acara Perdata, ruang lingkup asas hakim pasif serta penerapannya didalam beberapa putusan Mahkamah Agung.. Metode penelitian yang digunakan adalah studi kepustakaan yang bersifat yuridis normatif.

One of the principles in Civil Procedural Law is the principle of passive judge. This principle provides that a judge may not extend the scope of the case and give a judgment for something that is not claimed by the claimant. In the civil court practices in Indonesia, the application of this principle has shifted based on a number of judgments of the Supreme Court. This mini-thesis will elaborate the provisions concerning the principle of passive judge in Civil Procedural Law, the scope of the principle of passive judge, and its application in a number of Supreme Court judgments. The research is conducted through literature study and by using the normative juridical approach."
