"Monopoli merupakan penguasaan atas produksi dan atau pemasaran barang atau jasa. Tindakan monopoli pasar dapat menyebabkan matinya persaingan dalam pasar yang dapat membawa dampak yang merugikan. Monopoli ini tidak hanya dapat dilakukan oleh perusahaan swasta saja, melainkan juga perusahaan negara atau BUMN. Penerapan asuransi ganti kerugian pihak ketiga kendaraan bermotor di Indonesia dilaksanakan melalui Undang-undang Dana Pertanggungan Wajib Kecelakaan Lalu Lintas Jalan. Sifat dari pelaksanaan asuransi ganti kerugian pihak ketiga kendaraan bermotor ini bersifat wajib bagi setiap pemilik kendaraan bermotor lalu lintas jalan, yang dikuasai dan dikelola oleh perusahaan negara yang ditunjuk untuk menyelenggarakan program ini, yaitu PT Jasa Raharja. Pemerintah berargumen bahwa belum kondisi sosial ekonomi masyarakat yang belum memadai, sehingga penunjukan perusahaan negara dimaksud agar dapat memastikan tersedianya asuransi ganti kerugian pihak ketiga kendaraan bermotor. Pada kenyataannya, pelaksanaan secara monopoli ini terdapat beberapa kelemahan, seperti pelayanan yang kurang baik, birokrasi yang panjang, dan tidak terpenuhinya perlindungan sebagai tujuan awal dari penunjukan PT Jasa Raharja. Hal ini disebabkan tidak terdapat persaingan dalam pasar tersebut. Pelaksanaan dari asuransi ganti kerugian pihak ketiga kendaraan bermotor ini belum dilaksanakan secara efisien dan berorientasi pada pasar.
Monopoly is control over the production and or marketing of goods or services. An act of market monopoly can lead to the elimination of competition in the market which can have a negative impact. This monopoly can not only be carried out by private companies, also state companies or BUMN. The implementation of third-party insurance of motor vehicles in Indonesia is implemented through Law Compulsory Insurance Fund for Road Traffic Accidents. The nature of the implementation of third-party motor vehicle indemnity insurance is mandatory for every owner of a road traffic motor vehicle, which is controlled and managed by a state company appointed to organize this program, namely PT Jasa Raharja. The government argues that the socio-economic conditions of the community are not yet adequate, so the appointment of a state company is intended to ensure the availability of third-party compensation insurance for motorized vehicles. In reality, the implementation of this monopoly has several weaknesses, such as poor service, long bureaucracy, and non-fulfilment of protection as the initial purpose of the monopoly. This is due there is no competition in the market. The implementation of third-party motor vehicle indemnity insurance has not been implemented in an efficient and market-oriented manner. "

"This paper describes the historical origin of Indonesia's First Competition Law, which was enacted on 5 March 1999. The paper argues that a proper competition policy includes both: (1) market-opening or competition-promoting policies that enhance competition in national and local markets and (2) a competition law (sometimes referred to as art anti-monopoly or anti-trust law). The paper offers several critical notes on the Competition Law and argues that three major issues need to be taken into account in a future revision of the Law to ensure a consistent approach to the Law, namely:
1. Clarity in the definition of the goals of the Competition Law;
2. Universal application of the Law to alt business actors;
3. Clear division between market share and anti-competitive business conduct.
