"The adoption of the ASEAN Charter in 2007 represented a watershed moment in the organisation's history - for the first time the member states explicitly included principles of human rights and democracy in a binding regional agreement. Since then, developments in the region have included the creation of the ASEAN Intergovernmental Commission on Human Rights in 2009 and the adoption of the ASEAN Human Rights Declaration in 2012. Despite these advances, many commentators ask whether ASEAN can take human rights seriously. The authors explore this question by comprehensively examining the new ASEAN human rights mechanisms in the context of existing national and international human rights institutions. This book places these regional mechanisms and commitments to human rights within the framework of the political and legal development of ASEAN and its member states and considers the way in which ASEAN could strengthen its new institutions to better promote and protect human rights."

"ASEAN Intergovernmental Commission on Human Rights (AICHR) dibentuk dengan tujuan untuk mempromosikan dan melindungi HAM yang ada di ASEAN. Akan tetapi dalam realitanya AICHR masih belum memenuhi tujuan tersebut. Salah satu contoh yang dapat dilihat adalah dalam kasus Krisis Rohingya yang terjadi pada tahun 2017-2021. Dalam rentan tahun tersebut lebih dari 700,000 pengungsi Rohingya melarikan diri ke negara tetangga. Namun AICHR belum memberikan tanggapan hingga sampai saat ini. Melihat kondisi tersebut, tulisan ini mempertanyakan mengapa AICHR tidak menanggapi Krisis Rohingya tahun 2017-2021. Dalam menjawab pertanyaan tersebut penulis menggunakan studi pustaka dan wawancara sebagai metode pengumpulan data. Hasil dari penelitian ini menunjukkan bahwa ada dua faktor utama yang mempengaruhi sikap AICHR yakni faktor institusional dan faktor kepentingan negara anggota. Kedua faktor saling berhubungan sehingga tidak dapat dipisahkan satu sama lain. Kedua faktor itulah yang menyebabkan pembahasan Krisis Rohingya di AICHR tidak menemui titik terang.

ASEAN Intergovernmental Commission on Human Rights (AICHR) was established with the purpose to promote and protect human rights in ASEAN. However, in reality, AICHR hasn’t fulfill that purpose. One of the examples is in the case of Rohingya Crisis in 2017-2021. In that vulnerable year more than 700,000 refugees fled to neighboring countries. However, AICHR has not gave any responses. Seeing these conditions, this research questioned why AICHR did not respond to the 2017-2021 Rohingya Crisis. In answering the question, this research uses literature study and interviews as data collection method. The results of this research indicate that there are two main factors that influence the attitude of AICHR, namely institutional factors and the interests of member states. These two factors are interrelated and cannot be separated from each other. Those two factors made a deadlock discussion in AICHR."
