"ABSTRAKTesis ini membahas mengenai perlindungan hukum yang wajib dijaminkan oleh Negara Republik Indonesia dalam kaitannya dengan Ekspresi Budaya Tradisional/Folklor yang merupakan kekayaan dan jati diri bangsa. Ekspresi Budaya Tradisional/Folklor merupakan suatu kekayaan intelektual dalam bidang seni yang mengandung unsur karakteristik warisan tradisional yang merupakan sumber daya bersama, dikembangkan, dan dipelihara oleh komunitas atau masyarakat tertentu atau organisasi sosial tertentu, yang mencangkup verbal tekstual baik lisan maupun tulisan; Musik (vokal, instrumental atau kombinasinya); Gerak (tarian, beladiri, dan permainan); Teater (pertunjukan wayang dan sandiwara rakyat); Seni rupa (bentuk dua dimensi atau tiga dimensi yang terbuat dari berbagai macam bahan seperti kulit, kayu, bambu, logam, keramik, kertas, tekstil dan lain-lain atau kombinasinya); Dan Upacara adat. Ciptaan dalam pembatasanya pada Undang-undang Negara Republik Indonesia tentang Hak Cipta adalah hasil setiap karya Pencipta yang menunjukkan keasliannya dalam lapangan ilmu pengetahuan, seni, atau sastra. Folklor belum mendapat perlindungan yang efektif dari hukum positif tentang hak cipta di Indonesia, walaupun dikatakan sebagai hak cipta yang dipegang oleh Negara. Komersialisasi dan peniruan, serta pengakuan atau klaim oleh Negara lain, seperti oleh Negara Malaysia terus berlanjut tanpa adanya perlindungan. Kondisi ini merugikan bangsa Indonesia, bukan hanya pada persoalan ekonomi saja tetapi juga pada jati diri bangsa. Hal ini menjadi perhatian besar karena kekayaan Ekspresi Budaya Tradisional/Folklor yang beraneka ragam merupakan keunggulan komparatif Indonesia sendiri dibandingkan negara-negara lain.

ABSTRACTThe Thesis would like to talk about the law protection of Traditional Cultural Expressions/Folklor in Indonesia which ought to be priority in government concern. Traditional Cultural Expressions/Folklor is an intelectual assets in form of arts which hold the traditional heritage in a specific community, such verbal expression in both oral and written; Music (vocal, instrumental, and/or its combination); Expressions by action (dances, plays, games and traditional sports); Theater (puppet performances, stories, epics, legends); Handicrafts (in two or three dimension, formed by any skin, woods, bamboo, ceramic, papers, textile, et cetera, and/or its combination); And Rituals. Creation in copyrights regulation concerning the results of every work of the Creator is an authenticity in the field of science, art, or literature. Folklor has not received effective protection of the positive law in Indonesia, although said to be the copyrights held by the State. Commercialization and imitation, as well as confession or claims by other countries, such as by Malaysia continued without any protection. This condition is detrimental to the nation, both in economic matters and the identity of Indonesia. This is of great concern because of the wealth of Traditional Cultural Expressions/ Folklor diverse Indonesia itself is a comparative advantage over other countries."

"Mentawaians sing ritual songs enshrined in archaic texts referring to particular primates and birds, while ritual and traditional dances imitate how gibbons, sea eagles, and other animals live in the natural world. Mentawaians craft sculptures of endemic primates and unique birds. The bilou gibbon ape and various other animals also symbolize specific sacred knowledge within the sabulungan spiritual belief system and traditional cosmology of Mentawai society. Although some do succeed in surviving, many older traditions have faded away. Among the traditions which continue intact, this report aims to examine the roles of primates and birds across the arts and in the Mentawai belief system to reveal the profound depth of connection between humanity and the natural world throughout Mentawai traditional culture."
