"This book was made because of some changes in the legal field. An Oregon statute requires an accused to prove his defense of insanity beyond a reasonable doubt, a familiar concept in an unfamiliar setting. The Supreme Court enunciates the McNabb doctrine for the admission of confessions in the federal courts. The Federal Rules of Criminal Procedure are promulgated. The American LawInstitute recommends that adultery no longer be a criminal offense. The Court of Appeals for the District of Columbia discards the time-honored right-and-wrong and irresistible impulse tests for insanity. About two-thirds of the present work relates to the law of criminal evidence in general; about one-third relates to evidence in connection with specific crimes. New chapters have been added on scientific detection devices, self-incrimination, and tax fraud cases, and the text and footnotes of the other chapters have been brought up to date."

"Letter of Rogatory menjadi metode dalam memperoleh alat dan atau barang bukti di luar negeri. Dalam pelaksanaan penanganan letter of rogatory terdapat sebuah konvensi internasional bernama Taking Evidence Abroad 1970 yang menjadi bentuk formal kerja sama internasional untuk mendapatkan bantuan timbal balik hukum dalam masalah perdata. Indonesia belum meratifikasi Taking Evidence Abroad 1970, namun membuat PKS Indonesia-Thailand 1978 meskipun tidak terdapat informasi dalam pelaksanaannya. Oleh karena itu, Indonesia yang belum mempunyai sumber hukum positif hukum acara perdata internasional memerlukan kerja sama internasional, dan jika belum terdapat kerja sama tersebut, maka untuk mengisi kekosongan hukum untuk dibuat Nota Kesepahaman 2018. Penelitian ini dikaji dengan menggunakan metode penelitian normatif-yuridis. Lalu, dengan didukung dengan data sekunder berupa bahan hukum primer, sekunder, dan tersier yang dianalisis secara kualitatif untuk penanganan letter of rogatory yang komprehensif. Dengan ini, permasalahan yang diangkat adalah untuk mengkaji penerapan letter of rogatory pada Taking Evidence Abroad 1970, Perjanjian Kerja Sama Indonesia-Thailand 1978, dan Nota Kesepahaman 2018, dan untuk melihat efektivitas pelaksanaannya dari faktor penegak hukum dan faktor sarana dan fasilitas untuk melihat penanganan yang efektif. Dari penelitian ini didapatkan kesimpulan bahwa dalam sejumlah ketentuan yang berbeda, penanganan letter of rogatory pada Nota Kesepahaman 2018 lebih bersifat domestik, sehingga memiliki ketentuan yang lebih bersifat teknis dalam mengatur penanganan letter of rogatory di Indonesia menurut ketentuan tersebut dibandingkan dengan ketentuan lainnya meskipun terdapat persamaan ataupun perbedaan dalam sistem dan alur penanganan letter of rogatory, dan dalam mengkaji efektivitas hukum dari faktor penegak hukum dan sarana serta fasilitas penanganan letter of rogatory pada Pengadilan Negeri Tangerang sudah berjalan dengan baik, namun terdapat yang perlu ditingkatkan, ditambahkan, dan perlu diperbaiki.

A Letter of Rogatory is a method of obtaining tools and/or evidence abroad. In the implementation of handling letters of rogatory, there is an international convention called Taking Evidence Abroad 1970 which became a formal form of international cooperation to obtain mutual legal assistance in civil matters. Indonesia has not ratified Taking Evidence Abroad 1970, so Indonesia made the 1978 Indonesia-Thailand Cooperation Agreement although there is no information on its implementation. Therefore, Indonesia, which does not yet have a positive legal source of international civil procedure law, needs international cooperation, and if there is no such cooperation, then to fill the legal vacuum for the 2018 Memorandum of Understanding. This research is studied using normative-juridical research methods. Furthermore, it is supported by secondary data in the form of primary, secondary, and tertiary legal materials which are analyzed qualitatively for comprehensive handling of letters of rogatory. With this, the problem raised is to examine the application of letters of rogatory in Taking Evidence Abroad 1970, the 1978 Indonesia-Thailand Cooperation Agreement, and the 2018 Memorandum of Understanding, and to see the effectiveness of its implementation from law enforcement factors and facilities factors to see effective implementation. From this research, it is concluded that in several different provisions, the handling of letters of rogatory in the 2018 Memorandum of Understanding is more domestic in scope, therefore it has more technical requirements in regulating the handling of letters of rogatory in Indonesia according to these provisions compared to other conditions even though there are similarities or differences in the system and flow of handling letters of rogatory, and in assessing the legal effectiveness of law enforcement factors and facilities and facilities for handling letters of rogatory at the Tangerang District Court has been running well, but there are things that need to be improved, added and need to be improved."
