"Keberadaan undang-undang perlindungan varietas tanaman dan undang-undang sistem budidaya tanaman merupakan suatu peraturan yang sangat penting untuk mendorong dan memberi peluang kepada dunia usaha untuk meningkatkan perannya dalam aspek pembangunan pertanian. Peraturan ini memberikan perlindungan kepada para pemulia tanaman untuk menghasilkan dan mengembangkan varietas baru, juga untuk mendorong terciptanya varietas unggul baru serta pengembangan industri perbenihan. Berkenaan dengan keberadaan kedua peraturan perundang-undangan tersebut terdapat suatu kasus yang menimpa petani jagung di Kediri, Jawa Timur. Oleh karenanya, skripsi ini memaparkan serta menganalisis mengenai kekeliruan penerapan hukum yang terjadi pada petani jagung di Kediri, Jawa Timur. Dalam hal ini, Pengadilan Negeri Kediri tidak memuat pertimbangan hukum yang tepat terhadap kasus Budi Purwo Utomo dan PT BISI Tbk. Untuk membahas hal tersebut secara komprehensif, maka tipologi penulisan skripsi ini adalah penelitian kasus. Agar terciptanya penulisan karya ilmiah yang mengandung nilai ilmiah dalam pembahasan juga pemecahan permasalahan, maka skripsi ini menggabungkan dua pendekatan undang-undang dan pendekatan kasus.

The existence of the Law on Plant Varieties Protection and the Law on Cultivation System is important in order to promote and provide business community an opportunity to enhance its role in developing agriculture. The regulations provide a protection to plant breeders in promoting and developing new and high yielding varieties, and to enhance breeding industries. This thesis elaborates the misimplementation of the Plant Varieties Protection Act and the Cultivation System Act on Corn Plantation in Kediri, East Java. In this sense, Kediri?s First District Court did not include an appropriate legal consideration of Budi Purwo Utomo v. PT BISI Tbk. case. The method used in this thesis is a case study. In order to achieve an academic goal, this thesis combines two approaches, notably law and case approaches."

"Rice farmers in Sidamukti, West Java plant several varieties of rice, sometimes planting twoor three varieties together in one plot of land. The decision to plant a specific variety is strongly influenced by farmers' agricultural knowledge, such as knowledge of varieties of rice, periods of maturation, tastes, characteristic of specific varieties, as well as knowledge of environmental conditions, including soil conditions, the need of fertilizer and seasonal changes. The author suggest that this knowledge, as a basis for decision making is at a pre-attentive stage that has become patterned, and its nearly or perhaps entirely out of conscious consideration. In fact, external situational factors operating at the start of planting play a dominant role in the decision to plant a specific variety of rice. A multitude of factors - such as pressure from village authorities to plant certain varieties in keeping with development programs; to supply of grain, fertilizers and water for irrigation; the desire to experiment, and the demands of landowners - often become significant determinants. The author arrives at the conclusion that studies of decision making processes that view knowledge systems as recipes or patterns for behavior must be supplemented by close observation and understanding the context and situation in which behavior is generated."
