" Hak Cipta merupakan bagian dari hak kekayaan intelektual yang memiliki ruang lingkup paling luas. Segala hasil karya intelektual manusia dihasilkan dari proses olah pikir dan kreativitas yang kemudian diwujudkan menjadi suatu ciptaan. Oleh karena itu, persinggungan antara hak cipta dengan hak kekayaan intelektual lainnya sering terjadi. Satu jenis ciptaan yang selalu berpotensi menimbulkan sengketa kepemilikan adalah logo. Logo adalah hasil karya seni lukis atau seni desain grafis yang dimaksudkan untuk digunakan sebagai tanda pembeda bagi badan usaha untuk membedakan produk atau jasa yang dihasilkannya dengan produk atau jasa badan usaha lain, selain itu logo juga sering digunakan sebagai lambang organisasi atau badan hukum untuk menunjukkan identitas mereka. Dilatar belakangi oleh sengketa yang terus menerus mengenai kepemilikan logo yang dimiliki oleh pihak-pihak yang berbeda yang telah memiliki merek terdaftar dan hak cipta tercatat, maka pencatatan hak cipta seni lukis logo atau tanda pembeda yang telah digunakan sebagai merek dalam perdagangan barang atau jasa serta lambang organisasi, badan usaha atau badan hukum tidak lagi diperbolehkan, sebagaimana diatur dalam Pasal 65 Undang-Undang Nomor 28 Tahun 2014 Tentang Hak Cipta. Kurangnya pemahaman masyarakat akan perlindungan hukum hak cipta pada khususnya menjadikan sulit bagi pencipta atau pemegang hak cipta untuk membuktikan kepemilikan ciptaan. Perlindungan hukum hak cipta bersifat otomatis begitu hasil karya cipta tersebut diwujudkan dalam bentuk yang dapat dinikmati dengan panca indera. Pencatatan hak cipta tidak diperlukan untuk mendapatkan perlindungan hukum, tetapi Surat Pencatatan Ciptaan dapat digunakan sebagai bukti awal kepemilikan hak cipta ketika terjadi sengketa atau ketika hak ekonomi atas ciptaaan tersebut akan dieksploitasi atau dialihkan haknya. Dengan berlakunya Undang-Undang Nomor 28 Tahun 2014 Tentang Hak Cipta, khususnya Pasal 65, diperlukan pemahaman lebih mendalam mengenai perlindungan hukum hak cipta oleh masyarakat.

Copyright is part of intellectual property rights having largest scope. All human intellectual property creations are generated from the process of thinking and creativity which are then embodied into a work. Hence, overlapping between copyright and other intellectual property rights often happen. One type of work which always potentially causes dispute of ownership is logo. Logo is a creation of painting or graphical design art intended to be used as identifier for business to distinguish products or services they are producing from products or services of other businesses, besides, logo is also oftenly used as symbol of an organization, legal body to show their identity. Given perpetually occuring disputes of logo ownership owned by different parties having registered trademark and registered copyright, registration of copyright for logo or distinguishing sign which has been used as a mark in trade of goods or services as well as symbol of organization, business or legal body is no longer acceptable, as regulated in the Article 65 Law Number 28 Year 2014 Concerning Copyright. Lack of understanding in society with respect to legal protection of copyright particularly, making it difficult for the Author or Copyright Owner to prove ownership of their copyrights. Legal protection of copyright is automatic in nature once the work is embodied in a form which can be enjoyed with the senses. Registration of copyright is not required to secure legal protection; however, Copyright Registration Letter can be used as prima facie evidence of copyright ownership when dispute arises or when the economic rights of the copyright will be exploited or assigned. With the enactment of Law Number 28 Year 2014 concerning Copyright, particularly Article 65, it is necessary to have better understanding of copyright protection by the society."

"Tracing adalah salah satu cara untuk melakukan penggandaan ciptaan, yang dilakukan dengan cara menggambar langsung di atas gambar atau foto yang menjadi contohnya. Timbul permasalahan ketika tracing dilakukan di atas gambar atau foto milik orang lain tanpa izin, yang menghasilkan gambar baru yang mirip atau bahkan sama persis dengan gambar atau foto contohnya. Penelitian ini bersifat preskriptif dan kualitatif yaitu dengan meneliti berbagai teori tentang hak cipta baik dari peraturan perundang-undangan maupun doktrin dan yurisprudensi. Bahan-bahan pustaka yang digunakan adalah data-data sekunder yaitu peraturan perundang-undangan, literatur, jurnal, makalah, dan artikel. Penelitian juga menggunakan data primer sebagai bahan penunjang dalam bahan pustaka.
Hasil penelitian menunjukkan bahwa hasil tracing terhadap gambar dan foto tergolong ke dalam penggandaan ciptaan, dan jika dilakukan tanpa izin maka secara otomatis melanggar hak cipta. Untuk melihat apakah hasil tracing tersebut melanggar hukum, perlu dipelajari per kasus dengan mendasarkan pada ketentuan peraturan perundang-undangan dan doktrin tentang hak cipta, termasuk ketentuan fair use dan doktrin de minimis. Untuk menilai perbandingan antara gambar hasil tracing dengan contohnya, faktor substiantiality dalam fair use dan doktrin de minimis harus digunakan secara maksimal untuk melindungi pelaku tracing yang beritikad baik.
Tracing dapat dianggap melanggar hukum jika dilakukan tanpa izin dan menghasilkan gambar yang sama persis dengan gambar atau foto contohnya. Terdapat kekurangan dalam peraturan perundang-undangan tentang hak cipta yang berlaku di Indonesia terkait penggandaan ciptaan. Untuk menyempurnakan undang-undang yang akan datang, perlu mengadopsi unsur fair use sepenuhnya dan mengadopsi doktrin de minimis serta memasukkan definisi atas istilah-istilah yang belum diterjemahkan dalam teks.

Tracing is one of the techniques to reproduce a work, which is done by drawing right on the top of a picture or photograph as the example. Issues arise when tracing is done on the top of a picture or photograph belongs to anyone else without consent, which tracing results a new drawing similar with or even completely the same thing with the example. This research is a prescriptive and qualitative one, by exploring some theories regarding copyrights, not only from the prevailing regulations but also from the legal doctrines and jurisprudences. The materials are secondary datas such as regulations, literatures, journals, essays, and articles. This research is also made from primary datas as supporting materials.
The result of this research shows that the result of tracing pictures and photographs is included in art reproduction, and once it is implied without consent then it is undoubtedly a violation against copyright. To see whether a tracing result breaks the law, it is necessary to study each case by using regulations and doctrines regarding copyright as the basis, including regulations of fair use and doctrine of de minimis. To judge a comparison between tracing result and its example, substantiality factor of fair use and doctrine of de minimis is necessary to be materials of consideration.
Tracing could be deemed as a violation against the law once it is done without consent and is resulting a similar drawing compared with the example. The prevailing regulations of copyright in Indonesia is lacking of rules regarding art reproduction. To maximize the upcoming regulations, it needs to adopt fair use completely, not only one or two factors out of four, and also it needs to adopt doctrine of de minimis, not to mention it needs most to define some important terms in the text.

"Dalam peraturan hukum Indonesia, program komputer dianggap sebagai suatu Ciptaan yang dilindungi dengan Hukum Hak Cipta. Pengaturan tersebut terdapat pada Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta, yang telah mengakomodasi program komputer sebagai Ciptaan unik yang membutuhkan bentuk perlindungan tersendiri. Undang-undang tersebut sayangnya tidak luput dari kekurangan-kekurangan yang pada akhirnya menyebabkan perlindungan yang kurang sempurna karena tidak dinyatakan dengan jelas elemen-elemen apa yang sebenarnya dilindungi dari Ciptaan program komputer. Oleh karena itu, dalam penelitian ini akan digunakan prinsip de minimis sebagai tolak ukur pembatasan dan pendekatan yang bisa digunakan untuk menyelesaikan perkara pelanggaran hak cipta program komputer serta membangun peraturan yang lebih baik untuk perlindungan terhadap program komputer.

Based on Indonesia's current law, computer program is considered as a copyrightable works in accordance to Act No. 28/2014, which has accommodated computer program as a unique works that needs its own kind of protection. The act in question, unfortunately, is far from perfect, and has its own shortcomings, particularly because it doesn't regulate nor state what elements it's supposed to protect. This research therefor hopes to create boundaries and approaches that can be used both on a copyright infringement cases and to create a better legislation concerning the protection of computer program by the use of the de minimis principle."

"Ketentuan pengecualian dan pembatasan hak cipta dalam TRIPS Agreement membebaskan anggota untuk membuat pengaturannya sendiri, dengan syarat memenuhi tiga syarat dalam Pasal 13 TRIPS Agreement. Hal ini menimbulkan menimbulkan perbedaan pengaturan diantara anggota WTO. Skripsi ini hendak menjawab permasalahan mengenai pengaturan, penerapan dan keselarasan ketentuan pengecualian dan pembatasan hak cipta di Indonesia, anggota WTO lain dan TRIPS Agreement. Metode penelitian yang dilakukan adalah yuridis-normatif dengan menganalisis norma-norma hukum dan penerapannya. Hasil penelitian ini menunjukkan bahwa terdapat dua ketentuan pengecualian dan pembatasan hak cipta yang berbeda diantara anggota WTO.

Agreement membuat ketentuan three step test yang bersifat terbuka sebagai penengah dari perbedaan tersebut. Ketentuan pengecualian dan pembatasan yang berdasarkan doktrin fair use, maupun fair dealing perlu memenuhi ketentuan three step test. Indonesia sebagai penganut fair dealing memiliki beberapa ketentuan pembatasan hak cipta yang tidak sesuai dengan TRIPS Agreement, yakni ketentuan Pasal 43 huruf C, E dan Pasal 49 ayat (2) UU Hak Cipta.

Exception and limitations regulations in TRIPS Agreement give leniency for contracting members, to regulate their own exception and limitations as long as they are in accordance to the three conditions in Article 13 of TRIPS Agreement. This has caused differences in regulations among WTO members. This thesis answers matters regarding regulations, applications and conformity of exception and limitations of copyright in Indonesia, WTO members and TRIPS Agreement. This research is conducted using juridical-normative method by analyzing legal norms and their implementation. The result of this thesis shows that there are two different doctrines used in exception and limitations regulations among the WTO members, fair use and fair dealing. TRIPS Agreement regulates an open-ended wording regulation called the three step test to intermediate the difference. Both exception and limitations regulations based on fair use and fair dealing must fulfill the three step test. Indonesia as a fair dealing adherent has a few copyright limitations that are not in accordance to TRIPS Agreement. They are article 43 C, E and article 49 (2) Indonesia Copyright Act."
