"Pengadaan Tanah adalah Setiap Kegiatan untuk mendapatkan tanah dengan cara memberikan ganti rugi kepada yang melepaskan atau menyerahkan tanah, bangunan, tanaman, dan benda-benda lain yang berkaitan dengan tanah. Penulisan tesis ini membahas mengenai pelaksanaan pengadaan tanah oleh pemerintah daerah dan upaya panitia pengadaan tanah dalam mengatasi masalah-masalah yang terjadi dalam pelaksanaan pengadaan tanah untuk pembangunan stadion olah raga. Metode penelitian yang digunakan dalam penulisan tesis ini adalah metode kepustakaan untuk memperoleh data sekunder yang berkaitan dengan materi pengadaan tanah yaitu dengan cara menganalisis peraturan perundang-undangan, dokumen hukum dan buku-buku yang berhubungan dengan materi pengadaan tanah, data yang dihimpun adalah data sekunder yang terdiri dari bahan hukum primer dan bahan hukum sekunder, untuk mendukung penelitian kepustakaan dilakukan tehnik pengumpulan data melalui penelitian lapangan dalam bentuk observasi dan wawancara kepada Kantor Pertanahan kota Palembang, analisis data menggunakan metode kualitatif dan hasil penelitian dituangkan bersifat evaluatif analitis. Hasil penelitian mengungkapkan bahwa pelaksanaan pengadaan tanah yang dilakukan oleh pemerintah daerah untuk pembangunan stadion olah raga telah berpedoman pada Keputusan Presiden Nomor 55 Tahun 1993 tentang Pengadaan Tanah Bagi Pelaksanaan Pembangunan Untuk Kepentingan Umum. Bahwa upaya panitia pengadaan tanah dalam mengatasi permasalahan-permasalahan yang terjadi dalam rangka pengadaan tanah untuk pembangunan stadion olah raga antara lain mengenai besamya dan bentuk ganti rugi yakni dengan memberikan kesempatan kepada masyarakat untuk menyampaikan keinginannya mengenai bentuk dan besamya ganti rugi agar didapat hasil yang disepakati oleh kedua belah pihak sehingga ditemukan jalan terbaik dalam penyelesaiannya dan mengenai adanya selisih luas untuk bidang tanah tertentu yakni Panitia Pengadaan Tanah melakukan musyawarah lebih lanjut sehingga diperoleh kesepakatan luas tanah yang digunakan.

Land Acquisition is any activities to acquire land by means of providing compensation to the person who divests or transfers lands, buildings, plants and other objects relating to the land. This thesis writing is dealing with the implementation of land acquisition by regional government and efforts by the land acquisition committee to overcome the problems occurring in the implementation of land acquisition for sport stadium development. Research method applied in this thesis writing is a bibliographical method to obtain secondary data relating to materials of land acquisition, namely by means of analyzing statory regulations, legal documents and books in connection with land acquisition materials. Data collected is secondary consisting of primary legal materials and secondary legal materials. To support a bibliographical research in the form of observations and interviews to Land Affairs Office of Palembang City. Data analysis applies a qualitative method and the results of research will be embodied in an evaluative analysis. The results of research reveal that the implementation of land acquisition carried out by the regional government for sport stadium development has been guided by the Presidential Decree Number 55/1993 regarding land acquisition for the implementation of development for public interest. That the efforts of land acquisition committee in overcoming the problems taking place within the framework of land acquisition for sport stadium development among others are concerning the amount and kind of compensation namely, by giving opportunity to the society to express their wishes on kind and the amount of compensation in order to achieve the result agreed by both parties and that it is found the best way in the settlement. And concerning any difference of area size for certain land parcel, then land acquisition committee will hold a deliberation so that it will be obtained the land areas to be utilized."

"ABSTRAK
The National Land Law stipulates that land procurement for the interest of the public as outlined in the principles of land procurement must be conducted through deliberation to reach settlement, whether in terms of land hand over or the compensation, and duress in any form and by whomever to the right holder is not allowed, including duress in using the institution of "payment offer followed by contingency at District Court". The implementation of land acquittal by PT. Jasa Marga (Persero) at Sub-district of Pesanggrahan, District of Pesanggrahan, South Jakarta, is deemed necessary to be examined since it has arisen a question whether it is conducted based on the applicable laws and regulations and how the protection is for the land right holder whose land is still on dispute. The research makes use empirical normative method and constitutes a fact finding research with explanatory research typology since it is aimed to find the fact on the problem that arises, and then the problem is explained and described in more detail. This research is expected to give solution to the existing problem by providing several suggestions to the stakeholders, so from the viewpoint of its form, it is also a prescriptive research. Data collecting is conducted through literature study and interview using judgmental sampling method. Following examination against the problem that arises, the data obtained are then analyzed using qualitative. analysis method. The outcome of the research reveals that the land acquittal conducted by PT. Jasa Marga (Persero) is in accordance with the prevailing laws and regulations, and the right holders of land that is still on dispute are given protection in the form of guarantee that compensation will be given to the right holders and in sufficient amount. It is recommended that the government determine land price in an objective and actual manner, not only when conducting land procurement for public interest, and give compensation by considering social, economic, and cultural factors of the community whose land is acquitted."

"Penulisan tesis ini membahas mengenai masalah-masalah yang timbul dalam praktek pengadaan tanah bagi pembangunan jalan tol Jakarta Outer Ring Road (JORR)di Jakarta Selatan oleh PT. Jasa Marga (Persero) serta upaya penyelesaiannya dan menganalisis apakah Keputusan Presiden Momor 55 Tahun 1993 tentang Pengadaan Tanah Bagi Pelaksanaan Pembangunan untuk Kepentingan Umum mampu mengatasi dan memecahkan masalah-masalah yang timbul dalam praktek pengadaan tanah bagi pembangunan jalan tol JORR di Jakarta Selatan. Metode penelitian yang digunakan adalah tipologi penelitian eksplanatoris dan penelitian hukum normatif. Teknik pengumpulan data dilakukan dengan dua cara yaitu penelitian kepustakaan dan penelitian lapangan dengan melalukan wawancara. Masalah-masalah yang timbui tersebut adalah tidak tercapainya kesepakatan mengenai harga ganti rugi, tidak digunakannya lembaga pencabutan hak sebagai upaya terakhir, adanya sengketa pemilikan hak atas tanah, disalahgunakannya lembaga konsinyasi di Pengadilan Negeri, tidak adanya ketentuan mengenai harga ganti rugi atas tanah yang telah dikuasai selama tiga puluh tahun dan adanya klaim pihak ketiga atas ganti rugi yang sudah dibayarkan kepada pihak lain atau masalah salah bayar. Dapat disimpulkan bahwa Keppres No. 55 Tahun 1993 belum dapat mengatasi semua masalah-masalah yang timbul dalam praktek pengadaan tanah karena masih terdapat beberapa hal yang tidak diatur dalam peraturan tersebut. Dipandang perlu untuk melakukan upaya pembaharuan ketentuan-ketentuan hukum mengenai pengadaan tanah. Selain itu, juga terdapat kelemahan pada aparatur pelaksana pembangunan, kurangnya faktor fasilitas yang mendukung dan faktor masyarakat yang terkena pembangunan seringkali mempersulit jalannya pembangunan."
