"The Judical Commission was establised to achieve professional, clean (corruption-collusion-nepotism free), and respectable judicial power which is also publicly sensible. Judges not only serve as mouthpieces of the law but also carry the law enforcement responsibility, in which their verdicts must reflect justice, fairness, expediency, and legal certainty. The impression among many Indonesians that Indonesia´s judiciaries have been tarnished due to the common practices of legal distortion has sadly confirmed that judical institution is identical to mafia law. The Constitutional Court´s verdict annulling the Law No. 2 CE 2004 (UU No. 2/2004)on Judical Commission which serves as legal basis for the commission´s operation has spoiled the organization´s effort in exercising its authority. This research is normative-applying legislation approach-and futuristicin nature. The research materials from academic literatures are thoroughly analyzed based on existing law, ita revision, and its future needs. The findings suggest (1) that Judical Commission be given more extensive authority in monitoring incumbent judges both in provincial and in regional levels in order to achievethe law supremacy, (2) that the judges´ autonomy and judical authority be balanced with better individual religious values which are in line with the code of ethic, and (3) that the Judical Commission implement good governance as it should.Keywords : The Authority of Judical Commission, Monitoring, Judge."

"Pelaksanaan eksekusi putusan Peradilan Tata Usaha Negara (PERATUN) yang diatur dalam ketentuan Pasal 116 Undang-Undang Republik Indonesia Nomor 51 Tahun 2009 tentang Perubahan Kedua Undang-Undang Nomor 5 Tahun 1986 tentang Peradilan Tata Usaha Negara (selanjutnya disebut sebagai UU PERATUN 51/2009), masih sarat tantangan dan problematika yang tak kunjung tuntas. Perwujudan cita-cita sebagai Negara Hukum yang tertuang dalam konstitusi negara Undang-Undang Dasar (UUD) 1945 saat ini tercermin dari pelaksanaan Peradilan TUN dimana putusannya seringkali diperhadapkan dengan ketidakpatuhan Pejabat TUN dalam melaksanakan putusan yang berkekuatan hukum tetap (inkrach van bewijsde). Pranata contempt of court dalam pemahaman sebagai civil contempt of court yang bersifat indirect of court sebagai salah satu peluang dalam mewujudkan kepatuhan Pejabat TUN terhadap putusan Peradilan TUN disamping diperlukan pengembangan mekanisme eksekusi yang hingga saat ini sebatas “eksekusi administratif” sebagaimana diatur dalam ketentuan Pasal 116 ayat (6) UU PERATUN 51/2009. Penelitian ini dilakukan studi kewenangan Judge Rapporteur pada Peradilan TUN Negara Thailand dikolaborasikan dengan kajian data registrasi perkara dari Sistim Informasi Pengendali Perkara (SIPP) Pengadilan Tata Usaha Negara (PERATUN) Jakarta dan data eksekusi perkara yang diperoleh dari Kantor Kepaniteraan PERATUN Jakarta, yang dibatasi pada rentang waktu tahun 2018 sampai dengan tahun 2023. Berikut dengan contoh-contoh eksekusi kasus yang disajikan berisi problematika peradilan yang berkembang bahwa putusan PERATUN seringkali diuji kembali melalui peradilan perdata oleh pihak yang merasa tidak puas dengan putusan khususnya dalam sengketa hak kepemilikan atas tanah. Penelitian ini diharapkan memberikan wacana baru terhadap perkembangan kondisi PERATUN di Indonesia saat ini dan menjadi sumbangsih terhadap perlembangan regulasi hukum terkait.

Implementation of the execution of decisions of the State Administrative Court (TUN) as regulated in the provisions of Article 116 of Law of the Republic of Indonesia Number 51 of 2009 concerning the Second Amendment to Law Number 5 of 1986 concerning State Administrative Courts (hereinafter referred to as PERATUN Law 51/2009), is still full of unresolved challenges and problems. The realization of the ideals of a rule of law as stated in the state constitution, the 1945 Constitution, is currently reflected in the implementation of the TUN Judiciary, where decisions are often faced with non-compliance by TUN officials in implementing decisions that have permanent legal force (inkrach van bewijsde). The institution of contempt of court is understood as civil contempt of court which is indirect of court as an opportunity to realize the compliance of TUN Officials with TUN Judicial decisions in addition to the need to develop an execution mechanism which until now is limited to "administrative execution" as regulated in the provisions of Article 116 paragraph (6) PERATUN Law 51/2009.
This research was conducted through a study of the authority of the Judge Rapporteur at the Thai State Administrative Court in collaboration with a study of case registration data from the Case Control Information System (SIPP) of the Jakarta State Administrative Court (PERATUN) and case execution data obtained from the Jakarta Administrative Court Registrar's Office, which was limited to time span from 2018 to 2023. Following are examples of case executions presented which contain growing judicial problems, where PERATUN decisions are often re-examined through civil court by parties. who are dissatisfied with the decision, especially regarding land disputes. It is hoped that this research will provide new discourse on the current development of PERATUN conditions in Indonesia and contribute to the development of related legal regulations.
